The police have and are doing an investigation. They are trained on knowing when testing is required. You don't infringe or let your rights be infringed upon just to "clear things up". Let's just make everyone prove their Innocence all the time so we know there is no covering up is a terrible take.

That is why I asked above what the protocols for drug/alcohol testing are in this situation. So far I have seen no reports that law enforcement has breached its duties.

true enough ... but less often when you have a seat belt on ... also the jarring without impact can cause it ... but in five or six articles about this I have not seen anything about him having a concussion and he was calm, clear and lucid at scene immediately afterwards. We are all guilty of inattention sometimes, and driving hurriedly non-defensively, which it sounds like he was doing. Black box will tell some. Taking 20/1 he wins again.

All this talk of haters, but if an average Joe:

* drove off the other side of the road and totaled their SUV, resulting in major injury to himself
* claimed they remembered nothing about the events leading up to the accident
* was known to have recently undergone back surgery, the recovery from which normally involves (and in the past has involved for this person) the consumption of narcotics
* has a previous DUI when he was found asleep at the wheel under the influence of multiple narcotics, Ambien, Xanax & weed
* in addition, any info they get from black box that indicates erratic driving and/or likelihood that he was asleep at the wheel

Is it reasonable to assume that law enforcement would not consider that probable cause for getting his blood sample from the hospital?

It's pretty much what I thought looking at the maps. Even if we assume that most people are driving around 60-ish MPH (the speed limit is 45), all the reports calling that stretch of road particularly curvy or tricky to negotiate are ludicrous.

I mean, if it's dark and the road's slick, then sure, maybe. But, in broad daylight under normal driving conditions, if you can't navigate that road safely, you should not be driving.

it's quite possible it's not so much covering up but more "omg it's tiger woods" followed by a "his legal team is going to scrutinize everything and if we do the slighest over reach it could be a media and legal nightmare"

a huge factor in determining whether they let something slide with a warning or not is how much legal resistance they'll get as that will dramatically increase their paperwork and ultimately reflect poorly on them if they aren't convicted

I was stopped at a red light a few years ago when an accident happened in the intersection in front of me while I was stationary behind the cross walk. Car wound up hitting my work truck a pretty good blow. I was not ticketed or held liable in any way. The company sent me for a drug test!

That’s common policy for many companies in the moving, driving, or construction/contracting trades when you’re in a company vehicle.

there was testing done (they weren't going to give him anesthesia for his surgery without knowing what's already in his system), but LE didn't believe there was probable cause for getting a warrant to get the results of that testing

Ambien taken too late is a *****. I once woke up in my running car in my garage with no memory of how I got there. Never took it again.
