All this talk of haters, but if an average Joe:
* drove off the other side of the road and totaled their SUV, resulting in major injury to himself
* claimed they remembered nothing about the events leading up to the accident
* was known to have recently undergone back surgery, the recovery from which normally involves (and in the past has involved for this person) the consumption of narcotics
* has a previous DUI when he was found asleep at the wheel under the influence of multiple narcotics, Ambien, Xanax & weed
* in addition, any info they get from black box that indicates erratic driving and/or likelihood that he was asleep at the wheel
Is it reasonable to assume that law enforcement would not consider that probable cause for getting his blood sample from the hospital?
