And how does prosecuting people who reasonably believe that the person is above age protect children? You can't disincentivize someone from committing a crime they had no reason to believe they were committing.

Yeah, you'd have no clues that she might be underage. Somehow "I thought she had to be at least 18" doesn't strike me as a particularly compelling defense.

By requiring people to exercise even more than reasonable care.

You are on record as stating that you have no problem with current laws even if you met in a venue for people older than 21 and you were provided with state issued ID that showed she was older than 21. This isn't and shouldn't be a compelling defense in your opinion? (keep in mind that apparently in several states, this would be a defense)

I dunno, if an underage girl gets a fake ID, lies about her age, goes to a 21+ bar, and then has sex with some guy there, I think the guy has a pretty good defense.

The girls behavior there is way more reprehensible to me than the guys.

My subjective opinion of what is reasonable is not relevant. But since you asked:

I think her being in a bar requiring ID is probably reasonable. If she used a fake ID she assumes the risk imo.

Yet if I negligently kill her but do so in a manner in which a reasonable person would also have made the same mistake, I haven't committed a crime. You see where some people might find an issue with all of this?

I dont see how people can disagree with this

The law is to protect against guys who prey on young girls. Guys who go to 21+ bars to pick up women are not out to prey on young girls.

Because fake IDs are an impossibility.

The difference is that in that example you have less control over your actions than in the example we're discussing.

I assume you're talking about a situation where you think someone is pulling a gun on you and your belief is objectively reasonable.

you still seem stuck on the idea that guys who go to adult bars secretly wish they were banging 10 year olds in the back of their candy truck

And this is our point. When someone reasonably doubts that their one night stand might be underaged, sure, string em up. When someone reasonably isn't in doubt, maybe that should be a defense!

You shouldn't have sex with chicks that have been drinking because they cant legally consent if theyre drunk. age has nothing to do with it. guys who go to bars to pick up girls that could be too drunk to consent (which is, legally, a subjective level of intoxication) are disgusting and deserve to go to jail for it.

Why does this discussion have to happen in a thread I follow? There's a reason I don't open the Penn State thread.
