The statutory rape laws are a tough spot.
1) you have to protect from creepy old men and evangelical types populating the world in the old way
2) we want to respect voluntary choices
3) we know teenagers are dumb - they don't have the experience adults do and the brain area in charge of long-term decision making is still developing. It's the last part to develop.

So, what do we do when we want to respect voluntary choices but we know the ones being made are dumb?

If you're Bo, you drill sargent them into what you've deluded yourself into thinking is The Right way and never give young people the tools to think through things critically and develop the long-term weighing of options. You turn them into rote playbooks

Really, situations like this call for flexible punishments from the community. Some cases are worse than others and those enforcing blanket black/white laws really need to take a step back. When the 18yr old football player in Georgia spent years in prison due to a 16yr old giving him a BJ, that was whack. 23 doing a 13 year old stretches the mind. jmill provided visual evidence showing it can happen. We'd also need some verbal/thought evidence IMO to say this was accidental. Most 13 yr olds sound dumb as ****. I spend a lot of time in Barnes & Noble cafes (with my wife, not trawling for young girls you jerks) reading and whatnot as I like to sound smart whether I am or not.
