there's nothing in the article that indicates the suit is going horribly for the ncaa. if the plaintiffs get their request for class cert granted, then you could say that. but for now there's no indication it will be granted. but yeah, it would be pretty amazing if things actually do start going wrong for the ncaa.

Yeah I'd guess sexual assault could mean any form of physical constraint in which the goal is sexual activity. But ask one of the Stealers posters.

But would a news outlet report on a rape occurring if that's what the victim alleges or would they just call it sexual assault? Probably different policies for different outlets but just curious.

Legally? No. Different jurisdictions have different definitions of each term.

No, sexual assault can be all sorts of offensive touching and conduct without any sex taking place, while it can also be lots of more severe things and certainly includes rape.

EDIT: Thought I was the only lawyer in here unless Karak was posting.

Also the NCAA article is all hype and no substance. I haven't read the papers so I can't make any predictions or assessments of the arguments, but don't be surprised by the NCAA's attorneys acting as if they cannot lose. That's how lawyers act (in public) in litigation.

Probably call it a "rape allegation" if that's the charge, as opposed to a "sexual assault." In my experience, news outlets think of groping, fondling, molesting, etc., as a sexual assault and tend to specify allegations of rape as distinct from sexual assault. Also, both get viewers / readers, but rape gets more.
