I agree with this. It was at times clumsily expressed, but much of the stuff he was getting lolled at was reasonable.

For example, yes there is a spectrum of rape, which is not to say that any rape is even remotely excusable. Moreover, given the paucity of false rape claims and the strong evidence suggesting many rapes go unreported, every rape claim should be strongly construed in favor of the woman reporting. That said, is it that hard to see the difference between a malevolent assault committed while both people are sober in a parking garage and a guy going too far when both he and a woman are fooling around and both drunk at a party? Sure, the guy at the party is an ******* and should be punished harshly, but I don't think he's as culpable as the parking garage assaulter. Neither do judges when doling out sentences.

Edit: I 'think' what he was after is reasonable, but he did in fact say some lol stuff that gave pause. as a result the post was bad on the whole IMO

rape is rape. the kindest gentlest rape is still a heinous and deplorable act and is worthy of stiff punishment. sure, there are varying degrees of severity, but that doesn't mean the "least severe kind" is any more forgivable

boot posts can be interpreted as wanting other people to feel empathy for all humans regardless of how terrible their actions may be. ray posts can be interpreted as wanting other people to acknowledge that sometimes rape really isn't that bad.

The point is that humans are astoundingly poor and unreliable judges, historically, for when other people "deserve" human rights and/or dignity. "Rape/murder" is just as arbitrary as anything else; I'm 100% sure there are actions outside of this category that you'd find (at least) as morally heinous as many actions within this category. The entire philosophy of "fundamental human rights and dignity" breaks down once you start selectively applying it based on your own principles.

I mean I agree to some extent, Boot. But I don't know why a rapist would deserve my respect when that rapist has proven himself incapable of recognizing any shred of dignity of others. That's my viewpoint and I'll leave it at that. Maybe I'm a ****ty judge for not respecting two individuals who committed rape on an unconscious girl. So be it.

Just to clarify, and my verbiage may have been spotty here: I mean "respect for their essential humanity/human dignity" rather than "respect" in the personal/colloquial sense. I think that's a pretty important aspect. But happy to leave this here and glad this reply made it on the bottom of this page rather than opening a new one.
