How does the fact that it occurred in a bar eliminate the rationale for statutory rape protections?

because that isnt someone trying to prey on underage girls. its someone who wants 21+ girls and is being deceived.

years in prison does not seem like a fair punishment for someone who is trying to do the right thing and all of the evidence he has says his actions are legal

You aren't getting the question. Why is the girl with a fake ID due less protection? Veering dangerously close to "she was asking for it the way she was dressing" territory.

2) you assume everyone in said bar is 21+

They can't legally consent. Try again.

Anyways, it's not like this is some fringe position. A few states do in fact allow for a defense that there was a reasonable reason to believe the underage person was of age. For example, Arizona:

Quote:
B. It is a defense to a prosecution pursuant to sections 13-1404 and 13-1405 in which the victim's lack of consent is based on incapacity to consent because the victim was fifteen, sixteen or seventeen years of age if at the time the defendant engaged in the conduct constituting the offence the defendant did not know and could not reasonably have known the age of the victim.

What is the purpose of the law? Is it to protect young girls from being intentionally preyed on by older men? Or is it to protect young girls who knowingly break the law by falsifying their identity, drinking underage, and fooling bar staff into serving them because they were successful at concealing their age?

Edit: Then go have sex with older men under the pretense that the girl is 21+

Why does sneaking into bars remove them from protection of being preyed on by older guys?

Because the only reason the girl having sex with a guy is illegal is because of her age.

She lies about her age to people who are more responsible for checking her age than the guy having sex with her.

She knowingly breaks the law to put herself in the position, and in a lot of cases the guy had no intention of preying on a young girl.

So it's really a stretch for me to say your defense is "she was asking for it."

But they are consenting when they willingly decide to have sex with someone else, whether people making the laws like it or not, and whether or not they want to acknowledge it as such. But then you already know that.

a girl knowingly broke the law doing drugs and somebody she was doing drugs with raped her

well no they didn't actually rape her because she was knowingly breaking the law to put herself in that position

i dont care about the ****ing legal technicalities, im talking about what is right

there is absolutely no comparison between real rape and having sex that both parties agree to when the guy is 100% reasonable in believing the girl is of age

Have unknowingly brought back two chicks in my life from bars that were under 21. One was 18(during spring break in panama city) and the other was 19(myrtle beach). The fear of God was put into me each time when they told me afterwards they weren't 21. Fortunately 18+ both times. But God damn thats a scary 5 seconds.

You've already agreed to the premise of the law, so what do her previous actions have to do with it? We're worried about protecting children from making decisions they lack maturity to make well, but somehow an earlier bad decision on their part makes us not care?
