im not sure what post this is referring to but it depends on state obviously. for instance the law in the jurisdiction where i practice is the following:
A person also commits the crime of murder in the first degree, regardless of malice, when that person or any other person takes the life of a human being during, or if the death of a human being results from, the commission or attempted commission of murder, shooting or discharge of a firearm w/ intent, intentional discharge of firearm,...... robbery with dangerous weapon, kidnapping,
escape from custody, eluding an officer, burglary, ... unlawful distribution of a controlled substance, manufacturing a controlled substance.
lot of non violent offenses there.. plus a second DUI would also qualify you for felony murder (right or wrong whatever, but a cop trying to catch up to you after he sees you swerving and he hits a pedestrian.. murder 1)
eta- accidental meth lab explosions will trigger felony murder for whoever survives in this jurisdiction and there are A LOT of meth labs here.
