Doe testified he requested a meeting with Paterno and informed Paterno about what happened. He alleges Paterno told him he had “a football season to worry about” and walked away.

At least four children -- that we know of -- would become Sandusky's victims after this exchange of e-mails.

Presented with two instances of apparent child rape, and given a choice to protect the rapist of children or the children being raped, these three chose to protect the rapist. They didn't report their suspicions to authorities, didn't try to find the children to check on their welfare, didn't even take Sandusky into a small room and ensure than he never raped again.

I think at this point it's been effectively 100% proven that for multiple decades Paterno, every single AD, and multiple assistant coaches were completely aware that Sandusky was a serial child rapist and chose to willfully ignore it out of fear that the fallout would hurt the program.

Not sure what the charges would be, but seems like they should all be in jail.

It's absolutely stunning how so many assistant coaches can see something like this and all decide on their own not to report it.

Something stinks about it. I find it highly unlikely that everybody could outright ignore this for so long without some kind of implied agreement to not report Jerry and to keep this whole thing hush-hush. JoePa appears to have formed a culture around not reporting on Sandusky and letting him do his thing so long as he didn't tell any of them about it.

If anyone had reported it they're done as a coach forever (even now). and nothing would've happened to sandusky back then. Worst case he gets another job somewhere else. People generally don't fire themselves, gotta eat and all that.

It was incredibly standard back then for everyone to cover everything up. Doesn't make it right ofc but it's how it goes. Heck even now that happens a lot. At least some of them aren't getting away with it now so we're moving in the right direction on this.

Pretty much. Anyone who's reasonably intelligent figures out pretty quick there are unwritten rules at their place of employment. Carefully worded messages go out. Bosses are really good at cutting you off/changing the subject when it's something they don't want to talk about. Emails go unanswered. Etc.

I can't count the number of times at my job my bosses have communicated something like "do what you have to do but I don't want to know about it".

Add on top of that the pressure/reward of working for a major football powerhouse, then add on top of that the cult of Penn St. I can imagine a lot of lower-level employees would get the message in a very powerful way to just shut the hell up.

It would be "absolutely stunning" if we lived in some fairytale, truly democratic society where institutions were designed and controlled by the surrounding community to serve the surrounding community. But that's not the world we live in. Unfortunately we live in a world shaped by history where the good guys lost and the bad guys won. An extremely hierarchical, institutions vs people world where institutions are created by and designed to serve a tiny subset of people, and the underlings who work for and succeed in such a structure pretty much know without thinking that they must prioritize the needs of the institution over everything else. If that were not the case they would quickly be weeded out.

Normally the more people in on a coverup, the harder it is to conceal since there are more people liable to crack. Seemed that practically everybody knew to let Jerry to do his thing out of their sight. They were then able to keep this secret for over 30 years. That to me is incredible.

You would think that maybe some coach mentions it in passing and somebody overhears it to pass it onto somebody else. Or a staff member happens to refer to it in conversation with his wife and the wife tells a few friends which starts a rumor.

Perhaps one staff member gets fired, has an argument or gets screwed on a promotion and reveals this information as revenge. But nothing. Nothing at all.

Four years after he was convicted of child sex abuse, former Penn State assistant football coach Jerry Sandusky is arguing that serious missteps by prosecutors and defense lawyers are grounds for a new trial.

Mr. Sandusky’s current lawyer, Alexander Lindsay, has laid out a broad argument for overturning the June 2012 conviction in court filings. He compared the case, which shook the college-sports world, to a “modern day Salem Witch Trial.”

Judge John Cleland, who presided over the trial, has agreed to hear testimony on several of Mr. Lindsay’s claims, including that a prosecutor lied at trial about not knowing the identity of an alleged victim and that defense lawyers also knew the name but failed to call him to testify to rebut abuse allegations. Mr. Lindsay also claims prosecutors tainted the grand jury process by illegally leaking information.

The judge has scheduled three days of hearings, beginning Friday in Centre County Court in Bellefonte, Pa.

Wes Oliver, a law professor at Duquesne University, said that while courts rarely grant new trials, the “substantial claims” by Mr. Sandusky’s lawyer put his chances “within the realm of possibility.”

Mr. Lindsay also claims that the eight young men who testified against Mr. Sandusky made allegations of sexual abuse only after being pressured by investigators or coached by therapists and attorneys, who later negotiated settlements for the men with Pennsylvania State University.

Under Pennsylvania law, courts can grant a new trial for “ineffectiveness of counsel” if a person who has been convicted can demonstrate a reasonable likelihood that their lawyer’s incompetence led to the verdict. Mr. Lindsay argues that Mr. Sandusky’s former lawyer, Joe Amendola, doomed the defense with a series of blunders.

Among them, according to Mr. Lindsay, was Mr. Amendola’s telling the jury in his opening statement that the evidence against his client was “overwhelming”; allowing Mr. Sandusky to be interviewed by Bob Costas on NBC with little or no preparation; and not calling Mr. Sandusky to testify after promising jury members they would hear from him.

During the trial, prosecutors played the Costas interview, in which Mr. Sandusky hesitated before saying he wasn’t sexually attracted to boys, and they noted Mr. Sandusky didn’t testify at his own trial.

Mr. Amendola didn’t respond to a request for comment. He has said he didn’t have enough time to prepare adequately for trial.

Once again we venture into the realm of legal issues versus TAKES. My being thrilled that this obviously guilty imbecilic man was convicted is greatly blunted by this development, because no misconduct or incompetence of defense counsel was necessary to convict him. He may now deserve a new trial, though I doubt it.

As a legal issue, this new attorney probably has a point that the defense provided by Mr. Amendola was incompetent. If memory serves, Mr. Amendola put on a positively Trumpian performance during the defense. The opening admission that the evidence against Sandusky was "overwhelming" was a questionable argumentative gambit, to say the least. Though Sandusky is obviously guilty and even though a premier defense was probably hopeless, Sandusky is still entitled to a proper defense and appears to have a valid claim regarding the incompetence of counsel.

As another legal issue, prosecutorial misconduct violates Mr. Sandusky's rights regardless of his level of guilt, and might also justify a new trial. For example, prosecutorial failure to reveal witnesses favorable to the defense is abhorrent. For example, prosecutorial leakage of damning information - true or otherwise - to the potential jury pool prior to trial is abhorrent. I doubt this attorney can prove it, but if he can evidence it he has a very good point and claim for a new trial.

Put together, one narrative would be that the defense was a shambles and it was damned by prosecutorial misconduct. If that's what happened, I hope he gets a new trial because he deserves one.

And then I hope he gets wrecked, again, and withers in prison.

This is a great teachable moment regarding the hallowed value of due process and the right to competent representation. It is important to get these things right, even in cases like this, where a legitimate monster is there for what amounts to a show trial if handled competently.

This is the first pro-PSU, pro-Sandusky, pro-JoePa event in this entire thread that I find reasonable and arguably to be in the right. It's the only one. He'll still lose.

i'm not even a make-believe legal beagle, but i've read about loads of cases much much much much much more deserving of a retrial than this one that seemed to be met with a reaction of "lol, no"
