I see a ton of child abuse cases (probably about 1 a week) and my wife works with kids with the saddest stories ever. This GA is far from the worst you could do in this situation as far as witnesses go.
I highly doubt there is any mens rea requirement in regards to the Pennsylvania law surrounding reporting a sexual assault.

I also think if you're going to punish Penn State it has to be the entire athletic department, not just the football team. Yes the diddler in question was a defensive coordinator but most of this stuff (including the shower incident) occurred after he was retired. Sandusky's gonna spend the rest of his life in jail, the other major offenders are the athletic director, guy in charge of campus police, school president, etc. Goes way beyond the football program.

and that's why this is gonna be huuuuge. Penn St. could be bankrupted by this, which will affect every single dept.

After all of that, in 2007, Paterno allowed Sandusky to bring 11 yr old boy, who he was raping at the time, to multiple practices.

Mens rea makes a big difference between sticking a guy to the wall and giving him a cozy deal to testify bro.

I don't even know where to begin. I just read the grand jury report. Embarrassment and disgust are not enough.

re the NCAA has no power: Couldn't the NCAA simply refuse to let Penn State compete in their leagues/tournaments? Wouldn't that be effectively the same as a 'death sentence'?

The other member institutions presumably could kick out Penn State but that's
not going to happen

yes in theory

but the NCAA's hold over the colleges is very tenuous. they used to make money off the TV revenue on college football, but in the 80s the colleges got pissed with having to give them a share and split off on their own. and there's nothing stopping the colleges from cutting out the NCAA when it comes to the March Madness TV contract, which is the only reason the NCAA makes any money.

if they piss off enough big schools, they'll be told to **** off, so they can't overplay their hand.

The lesson here for parents is that if you're about to send your kid off to a camp or retreat of some kind, make sure the kid knows what innapproprite behavior is. The people most likely to do this sort of thing have often purposively worked their way into positions of trust where they have access to pre-teens whose parents have not educated them on the facts-of-life.

Yes, but I am saying in laws requiring reporting these type of crimes the mens rea just falls under "recklessness."

yeah

NCAA exists to police improper benefits and ****, so the colleges can collude to keep from paying any of the players and maintain the amateurism charade that everyone knows is a joke but pretend exists anyways. however, if the NCAA put too many schools on probation, the schools will get pissed off and go out on their own, so it's a balancing act.

if you haven't read Taylor Branch's brilliant article in the Atlantic about all this, do so

the ripple effects from this can't be understated. At the very least, Penn State alumni will cut off donations, and that will completely choke the athletic department and the university at large. I think the entire Big 10 will suffer from the results of Penn State not being able to recruit.

i think you're overestimating this, Penn State will (hopefully) clean house, and they have enough of a brand name in football that they'll recover. will hurt them in the short term but if they hire a good coach to replace Joe Pa they'll be fine imo

Again, what should JoPa do?

I am sure a lot of stuff comes to JoPa's attention and I am sure he just reports it to his superior as he is required to do. JoPa is the not the judge and jury; he is not privy to what happened once he reported it up the chain other than the person he reported it to (and to whom he was required to do so) investigated the matter.

The AD screwed up here as he tried to pawn it off to the charity by reporting it to them. That was a terrible decision and guess what? The AD is going to lose his job and he has been indicted for perjury.

As far as JoPa goes, he did know that Sandusky was barred from the locker room thus there was immediate discipline; he knew his superior investigated the matter; and he knew his superior reported it to the charity.

I will agree that without knowing more, JoPa should have followed up and assuming the AD tells him what was going on, JoPa should have tried to convince him to report it to the police directly rather than relying on the charity.

We went into this whole type of discussion with the Coach Kelly at ND thing. People who hate ND are going to insist the coach is a total POS regardless of the facts. People who hate Penn State will hate on JoPa regardless of the facts. In both cases, perhaps sticking to protocol is a cop out, but at this point, we really don't know. We do know that Penn State people have been arrested for perjury; we do know that JoPa is not one of them.
