"Fumble" is the key word there, that implies an additional later contact by the player who had possession. I mean, look at this part of the rule:
"If a player has his hand in contact with the ball and an opponent hits that part of the hand causing the ball to go out-of-bounds, the team whose player had his hand on the ball will retain possession."
That little exception existing makes it clear what the 'spirit' of the rule is IMO. They just need to explicitly line up the rule technically.
"Last person to initiate contact" is in line with how it's always been called, is spiritually in line with other OOB rules, is
far easier to judge (noone wants 5 min replays), the list goes on
