Could a GM hypothetically/realistically avoid a tampering charge/conviction in the following scenario?

Can you confirm if you will be making an offer to this unnamed player?
GM: If I was the hypothetical GM of a hypothetical team evaluating hypothetically soon to be top FAs, it would be idiotic for me to not make an offer for the highest scoring FA in the hypothetical FA market.
(I played around a lot with the wording; please dismiss the lack of realism to such a scenario actually occurring and only evaluate the legality of such a comment based on the exact wording of the Q&A).
