This is likely but I'd put it at 5-3. They should def deny cert-need 4 votes to grant. Could be a circuit split coming, but that will more likely be an issue after the trial, and case may be moot by than.

Honestly though and maybe it's me just not looking into it enough but I don't see how the Courts can hold up the EO if they say that it's a temporary ban on the 7 counties, regardless of how dumb Guilliani is. I think the appeals court was 100% right, that the courts can oversee an EO of national security as an argument has to be near 100% certain to fail.

The "reviewability" argument is separate from the argument re: constitutionality, and is the most likely portion to get 9-0'd.
