They will delay it til Gorsuch is seated. There is no mandate on when they have to bring the case. I think Breyer may cross on this anyway

So you guys wanted another reason to filibuster Gorsuch...here it is. The marketing literally writes itself. Putting Gorsuch on the court would put innocent lives at risk and send people to violent deportation for absolutely no reason at all.

Turned to foxnews and Krauthammer says they should not pursue it further that way they can blame the court if anything (terrorism) happens. The levels to which the right are not only willing, but eager to stoop to are astonishing.
