IMO a lot would depend on how crucial Flynn would be to proving the case against other people. On one end of the spectrum, Flynn might be the only person with a certain document or who could testify about some smoking gun meeting. In that case, I think you have to give him immunity in order to get the other guys. On the other end of the spectrum, you have multiple credible, independent (and, crucially, admissible in court) sources of information regarding anything Flynn might testify about. In that case, I tell Flynn to pound sand wrt full immunity, but maybe consider certain plea deals where he gets some leniency in exchange for cooperation.

Breitbart is not covering the Kushner breaking news tonignt, at all. Headline is Cohn ****ting on coal at g7 conf.

To me that screams bannon knows this story might be the one to bring the house down and likely instructed lemmings to ignore it . I cant even find it in a sub section. They are literally the only site online not covering this. Very telling imo

Question for our legal minds. How does it work when classified information is a key part of a criminal trial? They can't hold the trial in secret, right? And a defendant has a right to a trial before a jury of his peers. Do they try to suppress the classfied stuff somehow? Seems like jurors may not get an accurate picture of the situation that way. Or does classified stuff just get strewn all over the place?

It could be ruled inadmissible, or perhaps only the Judge sees it, or it could be un chambers with the attorneys. Depends how sensitive it is.

Anything classified that might exonerate Kushner, Trump will declassify.

Anything that does the opposite...well I'll let you guess.

In love this talk of a "war room" staffed by Bannon and Kushner to "go on the offensive" regarding the Muller investigation. So, a few aggressive nonlawyers who way overestimate their own abilities (thanks to dad and Seinfeld) against the FBI and Muller.

I worked for a Reagan-appointed federal judge in law school who was barely confirmed (unfairly, great judge), and he was happy when Muller was appointed to lead the FBI because of his integrity, smarts, and competence. This is when Mueller was just US Attorney for the NDCA.

These guys know nothing about govt/nat. security law, or law in general. Just operating a war room in the manner they desire will probably result in multiple obstructions of justice charges, on purpose and on accident. Then there's no AC privilege with them or even WH staffed lawyers, so anything that happens can be asked about, under criminal penalty, by the FBI. They need outside counsel at a minimum, and to not be conferring with one another. So, there will be no war room, just Spicy/Huckabee lying their ass off and dodging, telling the principles not to give them actual info or it could implicate them. Trump's lawyer should demand review of any proposed tweet, etc.

This is no different from JaRule and that biz tool deciding it would be an awesome idea to have a music festival in the Bahamas (Fyre Festival, look it up) while having no idea how anything of this works. It all went to **** and they appear to have no idea why. They will learn over the course of multiple class actions. Again, there will be no "war room" just as there will be no actual "recordings" of Comey or "trial" in the Trump U case. These guys are all bluff and no knowledge. In fact, it's unfair that they get dealt the worst cards and insist on bluffing every hand. This is 25% into the process where the lag fish goes from up $2k to stuck.

BTW, apparently, Muller gets his own choice of personnel. They will be ringers.
