Anyways the guy had a record so obviously that was a mitigating factor. I went through a civil suit against several involved parties that lasted over ten years.

I wish I could say I did or said anything at all to have made it seem encouraged or some kind of confrontation. Besides his sentence he owed me restitution of like $5000 and I think I got a $14 check once.
I'm reading the statute and holy **** does Hawaii have some draconian penal laws. Sounds like the guy who attacked you was charged with Hawaii's "Assault in the Second Degree," a class 'C' felony punishable by up to 5 years in prison (and he got the max to boot).

markksman was seriously hurt (broken jaw), the attacker had a record, and, not to diminish markksman's attack, but there could be a racial element to the severity of the charge and sentencing here.

On a completely unrelated note what is your opinion on how police should deal with violent urban thugs in the inner cities? Do you favour leniency or a more throw the book at them approach?

In the Brussels capital region that may be considered a summary (misdemeanor) assault and battery charge whereas in other provinces such as Hainut or East Flanders that attack could be an indictable (felony) offense.

Thursday’s NATO meeting was scheduled to allow Trump and leaders of NATO states to take the measure of each other. The 27 other members had hoped to relieve anxiety that arose during Trump’s campaign, when he questioned why the United States was spending its own money to defend Europe, called NATO “obsolete” and ill-equipped to deal with terrorism, and threatened to withdraw if other members failed to pay their “fair share.”

I'm not debating that, I'm just saying, in my experience, in my state, 5 years is a lot of time for a one punch assault. Hell, in my state generally a broken jaw by itself isn't even enough to get you to the felony assault charge.

um, he was punched in the mouth unprovoked resulting in a broken jaw while he was VACATIONING in the state. better believe his attacker is going to get the book thrown at him, you don't **** with tourists- that **** costs money
