"Lawyers gathered on Sunday morning at Dulles International Airport said that border agents had told lawyers that they would not be permitted to see anyone who was being held. Sharifa Abbasi, 32, one of the lawyers, said a customs agent had told her that “upper management” had instructed agents at Dulles not to provide any information or access to lawyers at the airport.

By Sunday afternoon, lawyers at Dulles were considering seeking a contempt order from Judge Brinkema against the border agency.

In New York, lawyers for the American Civil Liberties Union filed a request for clarification with the Brooklyn judge who had blocked part of the president’s order Saturday night.

“Petitioners’ counsel have received repeated reports of individual members subject to the order who have been placed on planes, possibly deported,” the lawyers wrote in a motion to the court.

The confusion in enforcing the president’s order was particularly evident in the handling of those who have valid green cards, making them legal permanent residents of the United States."

California federal judge orders admission of individual who was deported back to Dubai.

"2. Respondents shall transport Petitioner back to the United States and admit him
under the terms of his previously approved visa.
3. Respondents shall communicate the terms of this Court’s order immediately to
officers in Dubai, and to authorities in the airport in Dubai holding Petitioner on
Respondents’ orders."

Wow, that's the first federal court decision to rule that there is a strong likelihood of success based on a violation of the establishment clause. If that reasoning carries through the whole executive order could eventually be tossed. Given that that's in the 9th circuit, it's likely that it survives appellate level review, and I also have to believe that with the current makeup of the supreme court, the worst case scenario is a 4-4 split (although I seriously doubt Roberts and Kennedy uphold the order either). Also, not for nothing, you know the court is moving at the speed of light when you find typos in a federal court order.

The thing is Trump is trying to implement many of his stupid, uninformed, incoherent campaign promises, or to make it look like he is. Build the Wall! (check, but not really because there's no funding, Mexico isn't providing any, and neither will the Congress); repeal and replace (check, but not really, just a hollow executive order and Congress is ****ting itself); Muslim Ban! (check, but not really, as it's unconstitutional).

His staff have told him that the Executive has the most sway in immigration of all policy areas. This is correct. However, that power is hardly unlimited, and when you have dip-**** nonlawyers like Miller and Banno drafting the EO, which Trump signs without any understanding, you're going to get coldcocked by the courts.

Again, this is an area where the President has real power and significant leeway, but there are many areas, such as ACA repeal/replace, where the President basically can only sign/veto a bill approved by Congress. If Trump can't successfully work with Congress then his agenda is dead.

The only other area where the President has this much power is in military action and foreign affairs/diplomacy, which he will likely turn to more and more as his domestic agenda is blocked. Which is a bit concerning.

Trump is playing the last one and it's all or nothing. Everything else is irrelevant if it can't be enforced. His underlings are already doing what he tells them to do and not what the courts are telling them to do.
