The Gorsuch confirmation is a complete embarassment to the Senate and the United States. The Senate should not have taken extraordinary steps to ram through a man who is far outside the judicial mainstream, especially at a time when the sitting President may not be legitimately the officeholder (as he is currently under FBI investigation for possible treason and collusion with a hostile foreign power). As such, the Democratic Party should resolve to filibuster EVERY SINGLE THING the Republicans do from here on out. Every nominee, every piece of legislation, every tiny change to the budget. NOTHING PASSES without a filibuster. NEVER FORGET THE STOLEN SEAT OF SUPREME COURT JUSTICE MERRICK GARLAND

Democrats should be looking into any and every possible way to delay the swearing-in of Gorsuch. There is no constitutional mechanism to remove him from the bench after we find out the full extent of Trump's crimes with Russia. This is slingshotting us into a Constitutional Crisis from which there will be no extrication (an illegitimate sitting Supreme Court Justice that cannot be removed). Democrats must call this out for exactly what it is, a violent attack on the foundations of our democracy by the Republican party.

To be fair, Civil Rights were only supported for about 12 years after the Civil War, from 1865-The Compromise of 1877. We managed to support Civil Rights, at least partially (discounting mass incarceration and police brutality) for a solid 48 years this time. Counting from the 1965 Voting Rights Act to its dismantling in 2013 in Shelby County v. Holder

Next time Dems control all three branches I expect to see a push for court packing. The justification will be that this seat was stolen (it was), nominated by an illegitimate (and by the time I'm discussing, likely politically-radioactive) president, and confirmed by an exercise of raw power and an undermining of Senate norms (which personally idc about at all but will certainly be used as fuel in this argument). Obviously the dynamics of how this all plays out will depend on the rest of Trump's term and the balance of the court, but I think the basic argument will be "Rs ****ed us and the public to win control of the SCOTUS, now that we're in power we're going to take back what never should have been theirs in the first place." Note that I'm talking here about a different breed of Democrats than what we have now (I said "in power" so yeah ldo).

Maybe I spend too much time imagining the millenial-led utopia that will one day come, but I don't think you can overstate the disgust among politically active young people (who are vastly more informed about the reality of politics than the FNC-addicted useless Boomers) that Republicans obstructed Obama for a year to allow Donald ****ing Trump to nominate someone to the Supreme Court. There will come a day where the Millenials are in charge. I'm not generally a vengeful person but I hope Mitch McConnell's cryogenically sealed head is made to watch as they nominate and confirm four UC Berkeley lesbian professors in his name.

the second part of the constitution you have overlooked is the part that says it takes both the President and the US senate (advise and consent) to complete an appointment. Garland failed to get both. Since Senators are democratically elected their choice to deny consent is a democratic act.
