Well, the privilege applies to "communications". Cohen doesn't have to be "his lawyer", but the communications have to be related to the giving of legal advice and counsel. Hannity is sorta claiming he asked Cohen for legal advice now and then, which would be enough under some circumstances. It's kind of a Schrodinger's lawyer situation.
Unfortunately, unless Hannity is lying (which is not unlikely), Cohen didn't do an NDA for him to keep someone silent. Then again, Hannity may have gotten Russia/Muller taking points or information from Cohen, which would not be privileged, but Hannity probably gets that straight from Trump and Nunes.
