The copyright system is completely ****ed up. There's no way anyone would be confused between your kids bands version and the original - and there wouldn't be any loss of sales for the artist.
The "Dancing Baby" case - a short clip of a baby dancing around to Princes Let's Go Crazy - was taken through the courts by Universal for 10 years.
Infamous 'Dancing Baby' copyright battle settled just before YouTube tot becomes a teen
but settled before the court could answer whether the DMCA takedown was justified or not .... so they keep on doing it whether there's a case for fair use or not.
I mean how ****ed up do you have to be to then issue a DMCA takedown of a crowd of fans in Minneapolis singing Purple Rain on the evening of Princes Death?

... makes my blood boil.
As for REM - REM rights are owned by SESAC. I'm not sure REM themselves can do anything more than express their displeasure?
