Also possible is Drug Court, a rehabilitative program which the defendant can get into without the permission of the DA, and which will end up with no jail time and likely dismissal/reduction of charges at the end. The hammer of failing drug court though is eventually ending up in prison (although usually it’s just local jail time) if you continuously fail out and disregard the court’s instructions. Defendants on these types of probation and drug court sentences in NY are almost always given a ton of chances and “relapse” violations before they are ultimately kicked off and sent to jail. Again there are many states that you can point to where this is a significant issue, but NY isn’t a good example.

Also, again going back to NY since that was what was posted, there is no intent to sell statute in NY for marijuana, just controlled substances offenses (marijuana has it’s own statutory scheme which caps out at a class ‘C’ felony for more than 10 pounds of marihuana). The base level criminal sale of marihuana in NY is only a misdemeanor. This is all prior to it’s likely legalization sometime this year when that’s all going to get even more relaxed.

Passing a blunt between two people of any color in NY (again because that’s the state we were talking about) is at most a class ‘B’ misdemeanor. Further, if it’s a first offense the offender get’s a mandatory Adjournment in Contemplation of Dismissal, which means the case is adjourned for a year, and if they stay out of trouble for that year the case is automatically dismissed. This is the case for all misdemeanor level marijuana offenses in NY. That said, in 11 years as a prosecutor i never once saw police charge “passing a blunt” in this manner, they would almost certainly just charge both people with the violation level offense of unlawful possession of marihuana and give them a summons. They are still entitled to that ACD, but if it’s not their first offense they’re looking at a fine.

I wondered if Mar-a-Lago was set up like a Motel 6, with brochures from local businesses displayed in the lobby, except classy-like, which would have been where Kraft made his choice of spa, but then I figured they must have a spa on-site.

Someone needs to tell Trump his link is no good.

Your friend needs a new doctor who understands the basics of food science. You cannot get sick from medium rare steak as long as your cooking and cutting utensils are clean. The inside of the meat is not a source of food poisoning. It’s the outside that can make you sick.

All you do by cooking a steak well done is make it taste awful.
