If anything I think that's what's going to end up saving us, SCOTUS isn't going to want to set precedent for Presidents to just declare **** an emergency so they can spend money on it, especially if someone's a big enough bozo to hold a press conference where they say that it's not a real emergency but a scheme to get around the Constitution.

If he's nearly out of office or he's in some deep **** by the time they get the case, SCOTUS won't bother overruling it. That way they don't have to do mental gymnastics to rule the other way when the next president declares the climate emergency or whatever.
