The clause, which is found in Sec. 33 of the Charter, was intended to give Ottawa or the provinces a mechanism to overrule charter rights that conflict with their legislative agenda.

“I was elected. The judge was appointed. He was appointed by one person, (former Liberal premier) Dalton McGuinty,” the premier said, though his aides later clarified that Belobaba was in fact named by former prime minister Paul Martin because Superior Court justices are federal appointments.

“A democratically elected government, trying to be shut down by the courts — that concerns me more than anything,” he said, adding the courts have made him feel like “I’m sitting here handcuffed, with a piece of tape over my mouth, watching what I say.”

I don't even care about Toronto but I care about the precedent. It's too bad that MPPs have even less spine to stand up to their party then Republicans.

The notwithstanding clause has a built in bias that favors the shameless.

So now the city is taking the province to court over the province invoking the "notwithstanding the constitution" clause after the city took the province to court and won. Meanwhile the province is appealing the ruling over which they invoked the notwithstanding clause. Earlier all of the Toronto area federal liberal MPs (many of whom are in cabinet) signed a statement condemning the province for invoking the clause. And don't forget that former PM Brian Mulroney also condemned the province for doing this, oh and his daughter is the provincial attorney general.
