The guy was definitely driving under the influence. The issue is more that now "I thought he might need help" is just as good as having probable cause to make a stop. This case was like the least controversial possible example of how that ruling could play out.

Yea, I was just looking at the possible outcomes.

Hypothetical, kind of along these lines, a little more controversial.

I'm driving in a patrol car, see two vehicles on the side of the road, clearly involved in an accident. Both parties appear uninjured. No one appears violent.

Should I:

A: Roll down my window and ask if anyone needs assistance
B: Hop out, start doing an investigation into the accident
C: Drive by since no one called it in

And why?

I would say A is fine unless you guys have some type of affirmative duty to investigate accidents.

Yeah, but talking about the minimum DblJ is required to do seems a bit off the point, when what we should be worried about is the maximum that other cops, unlike DblJ, would be ABLE to do. "Hey look at those suspicious black youths over there...they sure look like they might need my help!"

Yea, it's a nationwide campaign.

I'm unsure about the idea of using them for actual patrol.

Relatively good idea for promotion etc though.
