Here, we get a preliminary trial before the actual trial where a justice of the peace or judge determines if there is sufficient evidence to proceed with an actual trial. It was determined in my case that the evidence was not sufficient to even make it to trial. I was let off and I thought that my troubles were over.
Then about a year ago, I get a letter in the mail stating that the government is initiating proceedings to confiscate my house under the civil forfeiture act. It is several years after I got off and they come at me with this.
I go see a lawyer and he tells me that nobody has ever beat one of these in BC. He says negotiating is possible but strongly recommends against me fighting it all the way. So now, it looks like a best case scenario for me is to give the government 60% of the equity in my house after also giving my lawyer 10k.
