The guy probably won't get away with it because he told on himself. However others will.
But I think this story is less trivial than it first appears. Partially because of the proclaiming what gender you are, unintended consequences. But more importantly because it raises the issue regarding when it is ok for a company or an individual to penalize an individual who is a member of a group that is statistically a bit more likely to have a particular negative attribute, even though that individual is not apt to have that attribute.
