Whitaker is just a right winger who lucked into an Iowa Ausa job (ain't that competitive) and kissed the right conservative asses to be appointed as US atty by Bush, which some have said is as bad as appointing him acting AG.
One thing conservative politics has come to hate is merit based hiring, because they believe (justifiably) that merit is contrary to their agenda. This was as true under Bush as under Trump. See Goodling, Monica.
yeah the conservative legal advancement structure is easily 3x less competitive than the liberal side. since both sides appoint roughly the same amount of people. (up until Trump, who is appointing a **** ton) conservatives are much more likely to make it up through because there are fewer of them around at higher education levels.
i would expect the talent to get even lower as trump appoints more and more judiciary.
