I am very proud of our president for standing up to the department of labor. They should not have the power to make such a law - it makes no sense for that to be under their jurisdiction. Unfortunately the real reason this law almost got pushed thru is based off the fallacy that managed investing can't beat passive investing going forward and the large companies w/ robo style investing and FAs who don't service their clients are the ones pulling the strings here. Even if you, incorrectly, disagree w/ me about the passive vs. managed argument if you also deny the fact that there is value to having a pro manage most people's money then we don't need to waste our time talking about this issue.

What we currently have is a country where you can freely choose a FA who is a fiduciary or a FA who is not. What this rule would have done is limited our options to just one of those.

Don't get me wrong their are some FAs who are scummy, but like almost all other occupations they are mainly good people who look out for their clients. And like so many laws passed under obama watch this is screwing over the people who most need help. Go call 10 firms and tell them you have $100k to invest and ask what they say then go back 5 year ago and do the same and see what you find. (hint: during one of these times you would get 10 people who want to help you and the other time the majority of those calls would result in you get hung up on).
