I realize that a cop has the ability, legally or otherwise, to make my life hell if he chooses. I make it a point not to do anything that increases the chances of him choosing to do so. Being an uncooperative ******* is one of those things I choose not to do.

I agree with not letting my vehicle get searched without probable cause. But when you're running up and down a hill on the side of a freeway and a cop stops to talk to you and ends up asking for ID, that just seems like a weird spot to choose to take a stand against the man. But hey, can't let them keep you down, right.

I'm unfailingly polite to police officers, and it's quite possible to take the line LoL suggests without being a jerky douche about it, although that might be more difficult for some of us than others. LoL's basic point that there's no upside to engaging law enforcement in conversation is correct. Tell me, EC, in the off chance that the FBI showed up on your doorstep "just to ask you a few questions," what would you do? Ask Martha Stewart or any number of others how wise it is to talk; indeed, if you make a mistake in what you say, you may have just committed a crime.

I would step outside with them, close the door to my house, and ask what it's about. I would have no issues answering questions for them if I had nothing to hide. If the conversation took a turn towards me being accused of something, it would end there. They could either arrest me or leave me be and move on with their day.

No chance my first reaction is ever going to be "nope, not saying a word unless I'm under arrest".

I work in a small office right next to a production plant. Some workers at the plant were having tools stolen. The police came in my office to talk to me about it. They asked if I'd seen anyone suspicious around, etc. Knowing I wasn't involved in any way, are you suggesting I should refuse to answer any questions? What if I had seen someone around the plant who doesn't work there? Should I tell them, or just refuse to cooperate?

He sees me zip up the hill lightening fast, that no ****ing bum or copper thief could ever do, so what's his motive? Strip off his uniform and he's just another dude asking for info that he has no right to know; with his uniform, he still has no right - that's why he said he didn't have the right to require ID.

He has no probable cause to ask for my personal information, just like a cop asking to search a car with no probable cause. He even told me so, and I told him to gtfo (politely).

Serious question LOL......you're driving home one Friday night and come up on a DUI checkpoint. What's your play(assuming you've had nothing to drink)? Leave the window rolled up and hold up a sign saying "I know my rights. I don't have to talk to you"? Roll down the window and be cooperative, even though it's a minor inconvenience for you? Crank the music up and speed through screaming "**** the police"?

I understand this isn't quite the same as running up and down a hill, but same basic premise.....being asked by the police to do something you're not legally required to do.

There are exceptions, of course, to the general rule LoL posits. If a policeman knocks at your door and says "we have bad news for you" then by all means ask what. And after my house was broken into and I called the police, it'd be downright idiotic of me to not answer any questions when they showed up at my door. And there are definitely some line calls you may need to make -- but the underlying point remains the same, which is that police do not have to be either honest or fair in what they ask you and why -- and because that is so, you're taking a bigger risk than you think by answering their questions.

DUI checkpoint sober:

"Yes, officer. Here's my license and registration. Do you need my proof of insurance?"
"Blah, blah blah blah????"
"I'm sorry, but I don't answer questions."

Nah, El D, I wouldn't ever drive drunk, but I got pulled over by a cop who thought I was, and I made him look like the little bitch he was. A sober guy with some backbone against a sober cop who thinks he's against a drunk driver is a comical experience.

I actually had that flier in mind when I asked the question. His refusal to answer questions comments made me think him having it was a possibility. That said, I'm glad to see he would take the time to roll down the window and speak with the officer.

I'm assuming there's about a 0% chance you'd agree to a breathalyzer in that situation? I haven't been through a checkpoint in many many years so I'm not sure what current procedure is, but I recall going through one when I was under 21 and they were requiring everyone 21 and over to submit to one. But this was almost 20 years ago.

The problem is you can blow a 0% and still get a DUI, so breathalyzer means dick (sorry to not answer your question, though).

I hope you didn't comply with that one. That wasn't a real police officer, it was a stripper in a cop uniform.
