I got pulled over today for the first time in over 10 years. I was given a 206 dollar ticket for driving while using a handheld device.

That seems quite high to me.

I was very nice to the cop. He still gave me the ticket. But because "I'm a working man" if I plead Not Guilty and show up to court with a hands-free device, a receipt dated after the stop, show him that I know how to use it and bring a certified copy of the last 5 years of my driving history, he will throw the ticket out.

Can he really do that?

Assuming, I do all of that any idea if it shows up for my car insurance and will my premium go up?

If I were an insurance company I would raise my premium, but I don't feel like paying extra for a ticket that gets "thrown out".

Just pay it and forget about it?

Take his word and plead not guilty? Am I screwed with the insurance company either way? FWIW, the license is from PA and the violation occurred in DE.

You should be able to get a hands free device for less than $208. Hell, you could get a good one for less than $100. Seems like it's worth a shot.
Whats your other option? Plead guilty and pay around half that. IF the judge is feeling nice? Plus whatever insurance rates will climb?

I got an out-of-state speeding ticket, sent a check (like a real check) to the appropriate court and never heard a peep out of my insurance company

I’ve at least had an analogous situation where I received a ticket for driving with expired plates (not long expired, by less than a month), but was told that if I brought proof of renewal within 7 days the ticket would be dropped. They met their end of the deal once I did.

Also true, but that means I'm missing out on balut

Unfortunately I've had to give up pork, so that means a lot of banh mis are off limits to me but I do enjoy the places that offer chicken.

I was joking; it's one of the most repulsive things I've ever seen before. Great conversation starter if you meet a Filipino though.

I like you, but good. People who use their cellphones while driving are insanely irresponsible, and I wish more people got tickets for this.

That said, I would imagine what he told you is true, I don't see any reason why he would lie about it. Id do which ever is the most cost effective, paying the $206 or dealing with all that crap and showing up at court.

I totally agree. The thing is, I wasn't really "on" my phone. I had it on speaker phone but it was technically in my hand. It wasn't to my ear. I was stopped at a light. He was next to me in an unmarked car and I guess he saw me talking and holding my phone. The phone was in my hand that was by the shifter. I'm still not sure how he saw it.

I looked at the specific law and he seems to be correct BUT a first time offender is always fined $100 not $206. 2nd and third offenses carry a $200-$300 fine. Maybe because I had an out of state license he couldn't see that this was my first offense? Not sure why he went with $206.
