My grammar radar says it should be "P.S." -- but getting the caps right when I'm dictating into my phone while driving is definitely not a priority for me.

On the trial front, I will often make prop bets on getting words on to the record or similar things. In a fairly recent oral argument, I had to use various forms of the word "extraterritorial," including "extraterritoriality." One of my colleagues bet me $100 that I couldn't say it perfectly every time. In thirty minutes, I was seven for eight -- on the eighth, I said "eh-extraterritoriality" with a hitch/repeat in the first syllable.

I'm certain I could sneak in "penetrate" fairly easily. "McDaniel" would be rather more difficult. I'd probably see if I could find some vaguely relevant precedent to cite on an obscure point -- "That's the McDaniel case from my brief, your Honor" or something similar.

This is a really awesome prop idea. I can't wait to drum up some action for my trial next week.

P.S.: a quick search indicates there are plenty of "State v. McDaniel" cases to chose from!

Depositions are generally much easier. You can afford to bollix questions up and re-do mistakes; when you're in front of a jury, you can't do that. You can also do things in depositions you could never do in court . . . by way of example, I had a witness in depo with ten other lawyers in the room, and took almost a minute to formulate a question. I got a bunch of annoyed looks from the lawyers until my question broke a question line open and I crushed the guy. But it was uncomfortable sitting there, dead silent, staring at the ceiling, trying to come up with the precise phrasing this guy would buy. You could almost never do that with a judge in the room, particularly in a jury trial setting.

Either way, though, you run across some tough words -- particularly in medicine or the sciences.

Will you be looking for a new roomate? You should look for a gay man. This way you won't fall for a female and you won't have to endure endless hours of some guy pounding some chick. You're also less likely to bond with a gay thus reducing the likelihood of doing blow or drinking with him.
