Be sure to bring an mspaint to court. That's half the battle. Nobody in the court wants to take the time to reach a correct adjudication on minor bs

If the prosecutor doesn't dismiss, he might agree to a minor moving violation with no points and and a fine.

From watching the traffic court show, with him having a clean driving record he's better off with a hat-in-hand approach rather than defiance with the judge (if the goal is getting it tossed). You can still say you saw no sign but act remorseful, if they brush that off, hit them with the photos baby.

What I did tho, was when the prosecutor asked anyone there if they would like to discuss a plea bargain before trial, I went up after everyone was nearly done with her to talk to her about the case, flirted a bit, and she dismissed it before it even went to the judge. I largely blamed it on the cop but got her laughing and rolling her eyes about what idiots they are.

UPDATE:


The policeman representing the cop would not dismiss the charge and offered my no deals. If I had brought a copy of my clean driving for the past 5 years, he would have offered me a Probation Before Judgement in exchange for a guilty plea. I would still pay the fine and the 3 points would be hanging over my head (and given to me on top of any other moving violation) for the next 5 years.

So basically, with the PBJ I would still lose my license for any moving violations within the next 5 years.

The policeman who pulled me over is saying that I made the U-Turn at the light after I actually I made the U-Turn. There is a no U-Turn at that intersection.

So basically, I'm saying I made it at one intersection and the cop is saying I made it at another intersection.

I requested an arraignment and trial. My trial date is about a month out. I don't really know what to do. I don't have a dashcam (I do now) so it's basically his word against mine. Unless, he has video of me doing the U-Turn where he says I did. I doubt he show the video of me doing it at the legal U-Turn spot.

Is there anyway to request his footage of the events? Or maybe the traffic cameras? I think they just take pictures of cars running red lights but who knows.

If it's my word against a 25 year veteran of the state patrol, I'm gonna lose and get hit with the full fine + court costs and 3 points.

I can try to get a PBJ at that time with a copy of my clean driving record but they might say, "Nah Villian1, you came at the bull...enjoy the horns".

I really have no way of proving I didn't turn where he said I did.

I would like to know if they have video evidence of me committing said act before trial. Is that possible?

Is hiring a lawyer a bad move?

You should have never told them what you were going to argue. Now that they know you are saying it was ok at the intersection you did it at, the cop can change his story. If you would have waited for court to let the cop say, "he made an illegal u-turn here", you could have then said, "but it's legal there". Now, as you said, it's just your word against his.

The ticket says on it that it occurred at the illegal U-Turn intersection. I thought it was odd that the road turning into a shopping center had a route number.

You got screwed. Your word against his is a lost cause.

Can't you do traffic school to avoid the penalties? We have that option in AZ as long as you don't have a prior ticket within 2 years. Doesn't save money but avoids the points.
