I think we're talking about Virginia here, right? So this is the law on assaulting a LEO in Virginia:

In order to secure a conviction for Assault on a Judge, Law Enforcement Officer, Correctional Officer or Firefighter in Virginia, the government must prove that: (1) the defendant committed an assault against the complainant, (2) the defendant knew or had reason to know at the time of the assault that the complainant was a member of a class protected by the statute, and (3) the complainant was engaged in the performance of official duties at the time of the assault. “ Assault” is defined as an “overt act” that is either intended to do bodily harm to another person or to put that other person in fear or apprehension of bodily harm. The defendant also needs to have “present ability” to cause such harm.

Virginia courts have held that using one’s finger to similar a pistol and then pointing the finger at the police officer can be sufficient to violate the statute. Spitting on a police officer is also considered assault and battery.

A conviction for this offense in Virginia is punishable by a imprisonment of 1 to 5 years, confinement in jail for 6 to 12 months, and/or a maximum fine of $2,500. Virginia Crimes Code §18.2-57(C).

maybe, but our justice system is extremely lenient. maybe it's just because I'm in California and our jails are so insanely overpopulated that you're not seeing a prison cell for basically anything but violent offenses.

I'm really ignorant of the law but from my experience with it, the charges/penalties always sound way more serious than they really are.

I know a kid who got either a third or fourth DUI while awaiting sentencing for the previous one, did a few months in county lockup while awaiting sentencing and then managed to plead guilty to both of them in exchange for some sort of ongoing rehab + years of probation. I guess it depends how they view that assault charge, I doubt the second DUI alone would be enough

I've had a run-in or two with the law, and I felt like the biggest dumb **** in the world afterwards. Multiple DWI's, multiple larceny convictions, multiple drunk in public - like wtf? how is that even possible? How do you not have ONE MOMENT of self reflection and go "Hm, maybe I better take it easy for a while." Not only does she not see herself having any fault, she sees herself as a victim. It's unbelievable. There's either an incredible amount of delusion going on or she's a straight up psychopath.

It's pathological. It's absurd. When you factor that in with the histrionics and her getting this thread deleted/getting it undeleted/whining again and threatening to sue the site, it's just so beyond absurd I can't fathom anyone actually feeling sorry for this mess.
