Who cares if she lies about stuff?

Does she do anything that violates the lease? Did she damage your property or fail to pay rent?

If you want her out now because it's too unsettling you will have to give cash for keys and figure out a number that works for her.

How often are your kids at the place? It seems like your primary choice of tenants being guys in their 20s is a bad move. I rented rooms in houses random houses a couple times in my mid-20s. It would have had to be one hell of place and deal for me to consider having kids living there too. Ideal tenant for you should probably be a spanish-speaking migrant woman, who works and then keeps to herself.

My house is set up where the tenants live downstairs and we live upstairs. Private entrance. We never see them.

She came upstairs to hang out.

She's not just a liar. She's delusional. I have a month to month lease for a reason. This is the reason. I gave her a 30 day notice. We'll see what she does. If she doesn't leave i start the eviction process and move my family to my folks house.

I thought if you had a month to month lease and tenant isn't out after you give the month notice, you could just change the locks and put their stuff or on the curb. I certainly think you should be able to.

It's different for every state. In Colorado i have to post a 3 day notice to demand possession of property. Then after 3 days i go to court and start the process. It takes 1.5 - 2 months.

She just sounds like a weirdo. I can understand why you'd rather not have her there, but it's surprising that you have this attitude that she must go and asap. Seems a bit ott for some girl, that from what I can gather, just talks a load of ****.

You mentioned that you worry about leaving your wife/kids there with her alone - is there any strong reason for this? Or just that you think if she's delusional she will probably hurt them for no reason at all?

How old are your kids? If you have separate entrances and the ability to never even see her, why not tell her that in the past tenants didn't come to the main house to hang out and as a professional you'd like to keep it that way.

Even in California, where the tenants has the landlord by the balls, there are plenty of easy outs to get rid of a tenant. I'm surprised you don't have these same options.

Well, actually, Colorado is more ****-the-tenant than California, but seriously, that's a low bar to leap:

Not if the tenant is a nut and decides to dig in. Also, I haven't seen the holes in the story. Chick is crazy, he doesn't want her around and is willing to pay to get rid of her, but he is scared that she may use the law that's on her side to draw things out.

I mean, sure, some tenants will dig in, but that's why CYA is paramount. Don't be an idiot and rent if you aren't licensed, and don't rent without knowing the laws of your land. It's only a matter of time before you get a tenant that will nail a jackpot on your dime.

In California, any month-to-month lease can be broken with a written 30 day notice for absolutely no reason. You just have to tape the notice to the door. If the tenant really wants to go through eviction, then that's on them, but getting an eviction on your name is about the dumbest financial move you can ever do.

I just find this whole thread disturbing because we clearly have someone who doesn't know the rental laws of his state. You are renting a portion of the most important object you own, yet you didn't take the time to research, get a lawyer, learn tenant laws, and how to properly remove a tenant?

The Colorado tenant laws are summarized in a whopping 25 pages, which is probably more accurate than the 25 pages this thread is bound to become:

Here's the important parts:


A month to month lease is a rental agreement for a one month period that is renewed automatically each month until properly terminated by either party. Proper notice to terminate a month to month lease is done by providing written notice of the intent to terminate the lease at least ten days before the last day of the rental month. This ten day notification period may be changed to a longer time if the parties have a written lease a 30 day notice is a common modification.


And...

A landlord may not use any form of self-help eviction, including locking a tenant out of a rental property (“lock-out”).

Regarding the bold, why is anyone even discussing the idea of handing the tenant money?

Okay he gives her notice to leave at the end of the month and she doesn't. Do you think the sheriffs will be there on the 2nd to make sure she is gone? OP has stated multiple times that it is a couple month process.

I could have posted a 3 day right of possession notice right away on the grounds that I don't feel safe but I wanted to give her a chance to find a place so I decided to post a written 30 day notice to vacate instead. I taped it on her door. She confirmed via text that she got the notice.

If she doesn't vacate by that date I will post the 3 day ROP notice and start the eviction process. I have to go to the courthouse and file after 3 days. The the Sheriff's office is backed up 1.5 - 2 months but they will come out and remove her.
