This is wrong. According to the law, it is illegal to portray sex with a child. There was a guy that keep making porn with 18 yos pretending to be 12 yos, and he is currently in prison.

Question for RayPowers: Let's just take the most extreme example. Let's say you browse to a site that has an image of a girl who's 17.9. You click the thumbnail, look at the pic, and go on about your way (or your browser just downloads the thumbnail - does the law distinguish?). For some reason the FBI raids your computer. Technically could you go to jail and have to register as a sex predator over that? Does the girl have to look obviously underage?

I'm not talking about what would usually actually happen 99.999% of the time in this case, just what technically could happen. This one area just scares me because there's soooooo much discretion in the hands of the cops, prosecutors and judges. I feel like they could probably put half the country in jail tomorrow if they scanned everyone's computers for every image and applied the full letter of the law.

IIRC, though, a federal circuit court or two have held that porn is not protected if a real child's face is superimposed onto an adult's body.

It's very hard to stumble consistently upon underage porn without searching for it on the interwebs (unless you visit chans and sites alike I guess). Fwiw if this is just about staying out of trouble as long as you don't actively search for it or store your computer full of obvious underage pornography nobody will ever bother you because that one time you fapped to a porn that you thought was a 19 year old but appeared to be a 16 year old. Even if they do happen to raid your computer.
