Nah, wasn't going to just sit there and stomp my foot. I didn't want to be in a spot with zero leverage. But I did want to tell the manager my story in person, and hear from his mouth that he wasn't going to replace the tree. I never even got that satisfaction. And still haven't, surprisingly.

Writing bad checks is for sure a crime. Putting a stop payment on a check for a perceived lack of service, I'm pretty sure is a different story. I'd have to look into that, maybe a lawyer can assist with the crime I've committed, if I have. Kinda feels like I have actually.

Fruit not the issue. The tree never grew a leaf, or a twig. It looks exactly the same as the day I bought it, which actually, isn't bad, if it were winter. I bought it in winter.

Don't think so here. Credit card disputes where you swiped your card and signed, and confirm that with your cc company, are pretty hard to get compensated for. At least that has been my experience. So didn't want to do that.

My bank doesn't charge me to stop payment. Did it online, took 3 minutes.

Don't garden if you can't take losses. Wtf at stealing an apricot tree because your 2 attempts failed?! Research and find out where you went wrong or plant another type of tree that you don't actually kill. Also go to the nursery and say there was a mistake made and give them the money you owe. I feel sad that someone who is into gardening behaves in this way.

Back when I played cards every day, I did a calc once, just cuz I was curious. In 2007 I tipped poker dealers from live games only, about $6500. I played 1080 hours of LHE that year. Tipped about $2 per hand I won.

Perhaps, but I know Home Depot has a simple policy, if your plant dies, come back for a refund or replacement, no questions asked. It's a great, smart, policy.

Not "stomp your foot." Tell him whatever you wanted to tell him. If you wanted to hear from him that he wasn't going to replace the tree, I'm sure he could have arranged that.

My point was the biggest mistake you made that day was accepting his/his employee's bull**** explanation for dodging you.

Were both trees that died planted in the exact same spot? Maybe there could be an issue there with the soil or something.

If the tree was truly defective, I think the nursery should refund you but that is really hard to know. They probably get 1-2 customers a week who call to complain about something that didn't grow correctly and 90% of the time it's probably an issue with the customer, so I understand their policy.

Extremely chicken **** but I almost respect the play in some weird way. Had you picked a better situation to pull the check cancellation move I'd be fully on board with this. Not really my style but I'm gonna keep this play in my back pocket for the right spot.

Did you ever consider putting any blame on yourself for not taking care of the plants well enough? Apricot's are fickle in SoCal and avocados thrive in those parts.
