Writing bad checks is definitely a criminal act in all jurisdictions. When you get pulled over for speeding an a year or two from now and the cop says please turn off the car and step out then arrests you for an outstanding warrant for bad checks, then maybe you would wish you didn't get so offended by a clerk at a nursery.

The most offensive part of this story is you paid with a check. When you tip @ a poker table you probably tip 50 cent pieces.

So instead of just paying for the tree, now you'll also get to pay bank fees for the cancelled check

lol, this. 100% stealing.

That is a totally standard policy for every nursery everywhere.

I don't think I've ever used the purchase protection on my AMEX, but after the stories I've heard, I bet they probably would have just refunded me the money themselves if everything went down as you described.

Anyone know if fruit trees and the like are exempt from their policy.

I knew a guy who once missed a World Series game because he had to go see a man about a tree.

For small amounts credit cards probably eat the loss but repeat/egregious offenders lose their terminal.

Also this thread confirms that cheque is the superior spelling.

Was this the plan all along? Why else would you have your checkbook with you?

Never buy fruit trees from a nursery.

Costco is where it's at.

I wouldn't say bank fraud as he is within his power to stop a che(que) but certainly theft. They have probably reported OP to the police but it is just on the bottom of their to do list as it would be for 50 bucks.

I suggest going to your nearest hospital and act crazy hoping they put you on a 72 hour psych hold. This could be useful when your public defender (or internet lawyer) negotiated a deal.

The downside is the entire nursery industry keeps a black book of people they will not sell trees to, so you will need to use a third party cut out to purchase any trees in the future.

You could also just buy your fruit in a store like a normie.

You're not missing anything, that's pretty much it.

do you know what percentage of trees do not survive transplant?
It costs $50 to file a small claims here in Cali (last time I did it anyway). Doubt they'd do this, but I'd show up. And btw, lose. Being sad isn't much of a defense. Don't know about the transplant percentage, maybe 5%? I dunno.
