The whole point of this is that a 30% discount on a totally defective product is complete bullsh*t. I've already gone through what I think is a compelling argument that their product was in fact defective. Not only did they not replace the tree, the owner didn't have time for an unhappy customer when I was there, and never gave me a call back about it after I left, even though he said he would. That is crap, period. "We warranty trees only if we plant them." Oh really? Well f*ck you you piece of sh*t, how about you warranty the products you sell, and don't charge me double to do it.

Well, at least you are now acknowledging that it is his money and not yours. There may be hope for you, yet. The next step is to just go give it to him without requiring him to have to ask for it. The one after that is to apologize for your behavior. After that is getting a different haircut. Then therapy.

I thought the OP was a total ****** clown just for the fact they were bitching about a new plant that died, and then we get to the OP stopped payment on a check because the nursery had better things to do and didn't want to deal with someone complaining that a tree died.

The phone analogy just doesn't work. You need an analogy to something that requires assembly or skill and can be permanently destroyed by doing it wrong. Maybe something like cooking. Maybe your souffle didn't rise so you want the grocery store to refund you for all the ingredients or something. I think that's better.

When you go to the fruit store and get a bad piece of fruit, do you take it back and ask for a refund?

You are saying they have to stand behind their product as if they manufactured a piece of equipment. It's a plant.....

Total Bush league. Why couldn't you just call the manager and complain? You seem to think that these people are out to get you.

They stand behind their product as if it were manufactured, but only if you allow them to upsell you on having them plant it in your backyard.

Sparks ran the risk of not purchasing said upsell insurance policy. He felt confident. The plant failed. It's possible the plant was a dud. It's possible Sparks planted it badly. Sparks has proof of other plant success in same area. Nursery has proof of other apricot plant success.

When a company has this type of policy in place, and you opt to attempt to save money instead of purchasing coverage, you have to automatically expect to come out of pocket again if something happens to go wrong.

So I called Moon Valley Nursery to say hi. I was able to speak with Shay Taylor, the manager of the place. I gave him my rant. He didn't say a word while I told my story. At the end of it he said Tyler, I'm aware that you stopped payment on the check. As for the tree, we have a company policy about not replacing trees that we don't plant, I think you probably heard that from Sarah. But I hear what you're saying, and we want you to be satisfied with your experiences here, so let's just call it even. No need to send a check, we're all good. I realize you're a local customer and word of mouth is obviously important to us. I apologize for not being able to get with you that Saturday, but we're really busy on weekends and I'm sure I was just with another customer.

I asked him if there was a fee for the returned check and he said yeah, $25. I told him I appreciated very much what he was saying, and I would feel better if I sent him a check, then this could be a big love-in! He said absolutely not, just keep a good word out for us, and this is a done deal. We'd love to see you back here. I told him I was sending a check. He said, well, I can't stop you. And then he said next time I was there, to make sure and find him, and say hi, and he'd hook me up with whatever I needed. So that was pretty cool.

So I just wrote the check for $95, and somehow found an envelope and stamp, put it in my mailbox and put the little flag up. Not sure how long I'm going to live in this house, but that might be the first and last time I ever use that mailbox flag.

Lesson learned: If I do something stupid, don't necessarily post about it in OOT. Cuz you motherf*ckers here are not shy about calling out a b*tch for a b*tch move.

That being said the manager seems like a chill guy. Stop being a lazy dick and find time to go down there and make the business whole.

Also I’m sure he’s super stoked you shared his full name and place of business on an Internet forum full of crazy people. You’re just doing this guy favors all over the place

I’m not upset. It’s just funny and absurd he offered the guy another check. Just man up and go pay what you owe in person.

So in the end everyone ends up being awesome about everything. And yeah, OOT pulls no punches on suburban mores. I remember my thread about a neighbor complaining about my grass clippings in the street. Was rather surprised to find out i was being an *******.

So the OP ended up paying for the second tree after all just as if he never stopped the check in the first place, as well as the stopped check fee? And the manager never did call him back, but rather OP called the manager back? Sure makes all the OPs efforts seem fruitless.

So sorry for bumping this played out thread, but, I'll just ask.

My mail carrier refused to take my addressed stamped envelope from my mailbox, although the flag was up. For four days. Yes, I removed it, mailed it, and it's been cashed. End of that story.
