Well I had kind of a curious headspace, but very minimal visuals. Ive spent the last two hours watching shows about excellent hamburgers around the country.
got pulled over tonight around 1:30am for a headlight out. cops comes up does the normal bs. shining his light all thru my car trying to find some kind of probable cause then asks if im drinking or on any type of drugs. no im not i say then he shines his flashlight right in my eyes and says your pupils are very small for it being nighttime. im like yea man your shining a flashlight right in my eyes. says hell be back then comes up a few mins later like im going to need you to take a field sobriety test. lol i go no man i dont think so im not taking a sobriety test but you can take me for a blood test if you like.
another cops rolls up tries to interrogate me but then goes back with the other when i tell him where ive been and where im going is none of your business. tens mins later after sitting there with my hands on the wheel i get my citation and im free to go. i hadnt smoked all day so i was never worried just a heads up that you dont have to oblige to any type of tests or searches w/o probable cause
You totally do have to submit to breath tests if pulled over here. I'm fine with the alcohol ones. The weed ones suck because they can come up positive if you used anytime in the last 12 hours.

As someone else who declined a sobriety test, I have to say it didn't go that way for me. I was guilty, however.
Police set up roadsite test sites and randomly test people driving past. You can also be tested if you are pulled over for other reasons. All police are equipped with breath testing for alcohol. There are also saliva swab tests, which some but not all of the roadside stops have. The saliva tests positive for weed for very likely 6 hours and perhaps up to 12 hours after use. They also test for methamphetamines and that test is accurate for 24 to 36 hours after use. Weed and methamphetamines both being illegal, a positive test will lose you your driving license for 12 months on the spot.

I don't want to derail a perfectly good drug thread, so I will just say that pretty much every piece of legal advice you ever see related to driving and consumption of substances is very much predicated on your location and the laws in effect there.
Yeah. Refusing a breath test is not a good plan here. It is an offence equivalent to the highest grade of DUI. You could do prison time for it. We don't have the Fourth Amendment here. There are various protections under law - for instance, if a police officer comes to your house and says "yo can I come inside and search?", you can say "show me a warrant or **** off". However, it's not unconstitutional to make a law that says that people driving a vehicle on public roads can be stopped and ordered to submit to testing, and that's what the law says. I don't have a problem with it other than that it sucks that you can test positive to a substance that is no longer having a material effect on your driving.

i just looked it up in my state and most states you cant refuse a chemical test. so blood or breathalyzer tests youd face consequences if you wouldnt consent to one. a field sobriety test isnt a chemical test so those you are allowed to refuse but they sure as hell word it like its mandatory. his exact words last night were im going to need you to step outta the car for a field sobriety test. to someone who doesnt know the law theyd consent almost everytime
In CA you get an auto 1 year suspension of your license via the DMV for any refusal
Criminally it goes to court and would depend. Guess you can take it to the jury, but if the cops lies and says you were swerving or something you're probably screwed and end up with a DUI regardless of your guilt plus all the lawyer costs.

Then I had a thought. Flying machines predated television. Did those two technologies necessarily have to arrive and progress simultaneously? Could there be alternate universes or alternate simulations of the Earth where we're 2018 mechanically, Teslas and 747s and ****, but dont even have film yet? Or vice versa, we have smartphones but are still traveling by horse, and perhaps steam locomotives?
