Make "Active Bear Traps" signs and put them everywhere...maybe even have one or two bear traps close to where you know they frequent.

It’s been my experience doing stuff with / to aggressive red necks w guns does not end well. Call the bleeping sheriff already .

The signs would likely be quite counter-productive with these guys, perhaps even attracting more hunters. The traps are an intriguing idea, but undoubtedly illegal as being booby-traps.

Captain,

I'm sure you know this already, but there is a significant safety issue here. Not only is this guy hunting on your land, you don't know exactly when he is hunting on your land, which means he or one of his drunko buddies could end up shooting you accidentally while you are walking your own property.

That seems like an unacceptable risk.

I think you should try and reach some sort of accommodation. Leave a note somewhere he will find it suggesting that (i) you are open to reaching some sort of accommodation, but (ii) you will have to involve the game warden or sheriff if you can't reach some sort of accommodation.

These country hunter types are used to doing work on their hunting land. If you need work done on your property, they might be willing to help in exchange for X number of days hunting on your property.

Generally, yes. Ones that cause no real injury, like pepper spray, might be a gray area. One that cause serious injury are usually specifically forbidden by statute and would expose you to clear civil liability if not criminal. I seem to remember a case where someone sabotaged the straps on a tree stand and had to pay for the resulting injuries.

In general, you’d be fine to set traps for animals that you had a legitimate reason to trap like coyote traps around your chicken coops or some such, unless you knew that children regularly trespassed on your land which might require additional care. If you were in a dispute with hunters and put bear traps out, that wouldn’t fly. There is a certain amount of common sense — the court would try to determine if your intent was to trap animals or to harm trespassers.

Also, for the record, I’m not a lawyer — my wife is and I toyed with reading the law while she was in law school. Property and torts were my favorite subjects.
