Never got to see Stranger Things.

As soon as I got there he told me his internet was going in and out. Liar! But it was true. We got to see a little and then it would freeze.

I dunno how it went. No homerun obviously.

I think I'm a bit much for him (and maybe anyone?).

Question for fake lawyers of OOT:

My brother was skiing in Maine earlier this year and a woman and her friend came out of another trail uncontrollably toward him merging into his trail. His trail had no signs of a merge or to slow down so he was not expecting it. He swerved to avoid the first and was unable to avoid the second, making impact. My brother was untouched but the other person was injured and went off in an ambulance. He filled out an accident report with the mountain explaining the situation. He was skiing with someone who witnessed it all.

He is being served a civil suit in Massachusetts now claiming damages for the accident.

Assuming he was clearly not at fault and that he will succeed in the coming legal hassle, does he have any prayer at recovering legal fees or is he basically guaranteed to have to lose a bunch of money for this person's negligence?

He needs a real lawyer.

I would guess this is very state-dependent and would be better off if the suit were moved to ME rather than MA. He is better off simply paying attorney fees if he can't recover them (perhaps he can) than if he doesn't engage a good lawyer. In my area people used to go after the defendant's home-owners policy--no idea if this may happen with your brother. Maybe a real lawyer will chime in here. Good luck to your brother. What a PITA.

This is why when two soccer moms come flying into you at a ski resort and you steamroll one of them, you should IMMEDIATELY call it a day and leave the mountain POSTHASTE.

Filling out an accident report is next-level not smart. What good could ever come from that? Only bad comes from that.


They are going after your brother because they have no case whatsoever with the mountain. I'll be interested to hear why Howard thinks this was served in MA instead of ME. Has to be some reason behind it.

I've literally sworn off skiing altogether for stuff like this, as well as my older son having his leg carved open by a ski edge and my wife blowing out her knee on a ****ing bunny slope a couple years ago. Done!

Son ended up winning a +90k judgement after a full trial in which our lawyer had to prove gross negligence, as all MA ski resorts are protected from general run-of-the-mill negligence. He carved up a high-priced Boston attorney over the course of two days, which was a joy to watch. If you want his info PM me. He is a great defense lawyer as well.
