Except for residents of 2 states, Washington and Illinois, it is not illegal to play online poker in the US.
Except for a couple of States, it is illegal to operate an online poker site in the US.
It is, however, very difficult to deposit on an online poker site from the US, since US financial institutions are legally barred from transferring funds to online gambling sites with the exceptions of those States where it is legal and online race books (where those are legal).
Bottom line is unless you live in WA or IL, your only risk is financial (as opposed to legal) if you manage to deposit on a site like Bovada or Merge.
