Passed interview #3.

Have interview #4 with the person I am replacing on Monday at 9am.
The head hunting company, after being satisfied with my qualifications gave me a
courtesy call and let me know what to expect in interview #4.
I assume they want me to get hired as I expect they only get paid if I am the successful candidate.

I put my chances at 25% now.

The sale closed on Friday Nov 18th.
I received a cheque in the mail today Nov 21. Wild, but the title co. said there is too much wire fraud going on and they have no
way to recover funds if sent to the wrong account by wire. They insisted on sending a cheque by Fed Express.
The cheque was in an envelope left at my front door. Fed Ex rang the doorbell, but did not wait for a signature.
Will have to drive to my US bank and make a deposit.
Will likely end up diverting the funds into equity investing or a term deposit.

I think I passed interview #4 pretty well.

I have given enough talks on real estate and have plenty of keywords/phrases they are looking for.
I have all the skills they are looking for but we did not talk much about the hard skills. I brough up
other things that do not show up on my resume: My family's history in Vancouver, Motivation, investing, owners point of view
NOI, Cap Rate, FSR, property redevelopment, free infrastructure upgrades.. etc.

Person I am replacing will contact head recruiter and likely schedule interview #5 with the (overseas) Board of Directors.
Contacted the head interviewer as I was asked to, to give him an update on the morning's interview with the person I am replacing.
and he asked me to think of a few people that I could use as a reference.
.. He said .. not a letter. The person that you are asking to be a reference.. we will do a separate 30 minute interview with !
Funny that 4 of the top 6 that I can think of are all lawyers.

Currently I think I am at 40%. If they arrange the interview with the board of directors I will be the sole candidate or one of two candidates... so then +50%

Things I did this week to further my goals.


1) grinding on as a rental manager. Lots of regular stories with broken stuff and insurance claim. No arbitrations coming up.,,

4) The new Property Manager has the keys and will do about 7k in upgrades, half is for interior fire doors.
There is a main entrance into a mini foyer. In that interior space is three more doors that enter into two separate units.
1 door leads to main, 2 doors lead to upper. Those three doors need to be fire rated.
We have an approved tenant for the main floor, moving in Dec 1. They have a dog.
Asked PM what % of applicants have a dog. All do! Apparently everyone in Hamilton Ontario has a dog or cat.

Will be doing maybe 5 more self tests. ( Course material comes with 1000 previous test questions)
Supplemental Exam for me is 60 questions in 2h. First exam if you do not have a Rental or Strata license is 100 questions in 3h.

#11 continued.
Have a scheduled interview 4.5 on Dec 2. I say 4.5 because this is with the person I am replacing again. It is an in person interview.
If one of the board of directors is there, then it will be the #5 interview. If I get the job and take it. I will replace #5 with an investment that another property manager will manage. It still may be an Edmonton apartment building but it will not be actively be managed by me. It may also be another passive investment from a RE investment group. Will have to see how this goes.

#6 Realtor License. Did the review of my mistakes on the first 3 tests.. wrote one sample test for the next 4 days. 82,82,88,82%
So the funny story here is that I went to the exam without the property documentation. I needed to have a passport photo to
attach to the application. Was 15 minutes early.. waited in line for 5..found out i had to get this photo.
They said I could just go out and get one taken and come back.
I jogged the 1.5k to the Staples, got the photo and jogged back. It was snowing and I was in dress shoes and a sweater! hahah
So If you don't know, i post in Health and Fitness and do 3k minimum each morning. Have not missed a day of exercise in last 2 years.
Including the time to take the photos, traffic lights etc. total time 25min.
I started the test with 15 minutes less.
The test is 60 questions in 120minutes. 105 minutes in my case.
In the end I skipped the two longest calculation questions. The questions were not hard but they are multi step and take about 8
minutes or so to do. This compensates for the questions that take 5 seconds to do. I had timed myself in the 7 sample tests that I
took and had a very good feel for how fast I answer questions and how to maximize my score.
I completed the 60 questions excluding the two calculation questions, with about 15 minutes to go.
Instead of doing the two calculations, I reviewed all of the other text only questions as the English on
some of them are intentionally tricky. I guessed on the last two calculation questions.
Final Result was 82%. Passing is 70%.
Made a list of 9 realtors I know (representing 6 different companies) and have called one on the list already to see what the experience is like.
Wil talk to several as I have to be associated with a brokerage to actually register my license.

speaker was from a company that I have invested in on a Texas property.

11) Completed interview #4.5 Was supposed to be 60 minutes. Lasted 1h 45, because I had to go or it could have gone longer. Did not feel like an interview.
Was more a discussion of my philosophy on many different topics. No politics, no religion.
Was told that the company has been interviewing since March of this year and have gone through approximately 60 candidates in the last 10 months, many with solid experience.
Experience in doing the job was not what they are looking for because so many candidates have/had the experience, but were passed over.
My impression is that the interviewer is looking for an attitude, philosophy or some curiosity about the job (even at my age) so as to assume I did not know everything about the job or how to do the job.
I think I did very well on this "interview" I never had a topic come up that I was not versed in.
essentially I pulled many "points of view" from my many readings, that I agreed with to answer discussions.

ie. When discussing the other candidates, and being a successful candidate, the interviewer mentioned intelligence/competence as one of the requirements.
I pulled Warren Buffet's review out .. 3 qualities.
Intelligence.. Contientiousness (What I said was , one's ability to work when nobody is watching), and 3 integrity, otherwise you end up with
a hard working thief who will steal all the company's money... with those three qualities, you can be successful at whatever area you choose.

We talked at length on challenge and being challenged, managing people, how to lead, facing problems, emotions in business, family, raising children, view of money, salary expectation,
motivation (lengthy discussion on motivation) , where I saw myself in 5-10 years, learning, reading, more description of the job and how the board of directors expects information...
Why I wore a suit in the Zoom interview, prepared questions to interview questions, references (had 5 prepared, but never even got to that as
the interviewer would have known maybe 2 of them. ) How the interviewer got the job in the first place (9 years ago), professional real estate meetups, tax planning, combined portfolio financial statements,
trusts/bear trusts, languages.. more topics...won't list them all.

Had 2 books added to my reading list by the interviewer. Mental Toughness and Who moved my Cheese.

If I did well enough, there may be one more or up to three more interviews as there are three key board members I need to get a pass from.

11) Had my 5th interview with one board member company representative. Went ok. Did not do stellar. give my self a 70% interview rating. I put my chances of getting an offer at between 33% and 50%.
The one question that I should have done better on was ..
We have a large number of vacancies in our office space. What would you do to improve the occupancy?
I gave a generic answer. After the interview I thought of a much better out of the box answer.
i.e. if work from home persists and becomes a new standard of business, I would consider converting some or all of the office space to either live/work units or completely convert the offices into residential units, depending on the zoning, density and location of the office space.

#9 Flood event at my Vancouver warheouse. edited out last names etc.
Dec 23, snowed an additional 3-4 inches, on top of the previous 6-8" I measured the snow this morning at 9" deep.
Snowed heavily evening of Dec 23 to morning of Dec 24th.

December 24, 11:45am

I received a call from the tenant, at The warehouse.

He informed me that water was coming in from the ceiling in three locations. This was not a small leak. (several gallons per hour) He mentioned Sloan would know what to do. Sloan is usually in the unit across the parking lot, but was not in because it was Saturday and Christmas eve. Nicolai said that Eugene, the previous owner of unit #116 would have SloanÂ’s number. He also let me know that he has set up many 5 gallon buckets under locations where the water was coming in.

11:50 I called Property management co24 hour service. Was put on hold and was disconnected after 15 minutes. (I did not hang up).

12:05 I checked my notes and found Sloan is the Strata Council President. I then attempted to call the Eugene to see if I could get the phone number of Sloan. I was not able to get through.

12:10 I called Dwell PM again and was put on hold again. Once I did get connected, they took the rough details of the problem and my cell phone number. They said that they would page the Strata Manager Gregory who would then contact me.

12:15 Gregory called me. I gave the details and he said it would be hard to get anyone out there today and we would likely have to wait until Tuesday Dec 27 to have the issue looked at. I asked him to contact the tenant Nicolai and explain the same to him.

12:25 I called Nicolai and we agreed that I would come out and get on the roof and check the drains.

12:35 As I was leaving, Nicolai called back and said that Gregory had found a plumber to attend and verify that the leak was not a pipe issue. We agreed that I would not go out to the warehouse.

3:00 Nicolai called me again and let me know the plumbers had verified that this was not a pipe issue. They recommended that the roof drain be kept clear. We agreed that I would go and do that.

3:30 Went to warehouse. Unit 116. Met with Nicolai. Inspected the premises. The water ingress has slowed to about maybe 1 gallon /4-5 hours now. I expect that the water that is coming in now, is water that has previously leaked through the roof and is soaked or drenched into the ceiling tiles as it was no longer raining. About 1/3 of the upper floor is wet with water. The water is sufficient that it has run through to the main floor. The main floor is about 15-20% covered in water. Both main and upper floor, the water is held in the carpet and is visible as dark blue instead of a light blue. When I was there, Nicolai was running a (wet) carpet cleaner, sucking up water from the carpeted areas. He said that he had sucked up and dumped many loads of water. He had also set up about 10 buckets under the location where the most water was coming in.

We went through the offices and warehouse area. The area where the most water was coming through was around the skylight and area below where the AC unit was located. Nicolai had moved boxes, desks and other items that were under locations where the water was coming in. I took several pictures.

I went up to the roof, accessed from the rear of the building. For the first 10 feet we used a portable ladder to access the ringed ladder attached to the building.

When on the roof, I noted that there was only about 2-3” of snow left on the roof as it had been raining fairly hard all morning. The roof drain was clear and draining now and much of the snow surrounding it was all slush. (See photos at the end of the email)

The roof material was covered in large 2” smooth stones, which was not conducive to shovelling. As the area around the drain was clear, I did not shovel any snow or slush.

Nicolai continued to mitigate the damage and vacuum up more water when I left.

Will be doing lots of follow up in the next week.

#10 The Syndicator for my Sarnia Project has a new Storage project that he is pitching. I was one of the first investors he contacted as he wanted input on his sales pitch.
I have a good chance of investing in this project if he can come up with the other 3-4 investors needed to complete the financing.

#9 I checked with the insurance company and we do not have flood (natural water) insurance for this property. The definition
of surface water is river, sewer back up, and rain/snow. The warehouse is located in the flood plain next to the Fraser river
and the insurance company does not sell flood insurance for properties in the area.
To quote the insurance company exactly" :
"Your policy does not have Flood coverage which Intact cannot offer because the insured location is situated near the Lower
Fraser River floodplain. Even if Flood would have been offered, the deductible would be at least $25,000, way above your Contents limit of $11,950."

Purchased and delivered two mid sized (6 gallon) dehumidifiers to the warehouse. Most of the water was vacuumed up.
The tenant put space heaters on to dry out the carpets. As a result, the humidity has gone way up in the warehouse offices.
to rent industrial dehumidifiers cost $55/week and I would need to rent two of them.
Purchased and delivered two mid sized (6 gallon) dehumidifiers to the warehouse.
Hopefully I can get by with under 5k in total repairs.

I will keep grinding and investing in equities and RE for long term. Long term, the goal is still to make 100k per month of passive income.

Interesting that I got a call during the holidays from an old co-worker. He wanted to move into the Rental Department and there were no positions available so he took a job (in that position) at a different company. Told me that he talked to my boss and would have stayed if there was a position because he really liked the company and his new company did not have a good support system. .. accounting/trades/reporting systems etc. Told him I was thinking of leaving to get a trading license and that he should call my boss again at the end of this week.

2) Delta Warehouse, Tenant is behind by about $800 on their repayment plan. I sent them an email last week.

3) Equities Investing. More investing. I purchased Tesla at $110/share. and more last week at $110/share. Missed the temporary bottom at $104.

5) buying an apartment in Edmonton: Cap rates have barely moved. I look at the listings for properties and the cap rates are still 5% or maybe 5.5% at best.
I put some funds into a 1 year GIC at 5% Risk free. Not sure why I would buy an apartment building and take on all that risk until the cap rates hit 7.5% or better.

6) Realtor License. Interviewed my first company. Royal Le Page. it is related to Brookfield Asset Management. Cost will be about $800/m. They will give me a 50% break on the first year's fees. They have a different plan with a low monthly fee but they take a % of your realtor commission on every sale. I have an interview with a second company lined up. It is funny, but there are three large trading brokerages on the same street, each one block away from the next.

9) Vancouver Warehouse. Dehumidifiers have been working. Majority of water is out. there is a smell to the carpets now. Have scheduled a carpet wash and de-odorize for today. Will visit the tenant tomorrow and assess the smell, ceiling and wall damage. Hopefully I will not have to change any carpets.

10) Wainwright Storage. Waiting for Syndicator to ask for $. He was in Wainwright last week. No update yet. They should be closing at the end of January, unless he asked for an extension.

11) Called the head recruiter back. I estimated the owner/board member would have gone back home and had his first board meeting on Monday, Jan 9 to make a decision.
He told me that they were offering the job to another person with more experience in this type of work. I said excellent and wished them well.
I had the feeling that they didn't contact me yet because they did not get the other candidate to sign on the dotted line yet. ie. My chances are say less than 1%, and they would have only called with good news if for some reason the other person backed out. BACK to PLAN A

#1 Forgot to mention that, after I leave, I will miss the "trades events" and lunch and learns that I get invited to all year long. This is especially true at Christmas time.
Lots of Restoration companies, roofing Co., Plumbing Co. , Property Maintenance Co, etc. is sending you bottles of wine and gift cards, sponsoring lunches and dinners and giving talks on everything property management related, hoping you will use them on your next job.

#8 Story from My PM just sent it to me 15 minutes ago. RE: Detroit Judges and evicting non paying tenants.

Hello,

Although it says first hearing, this is actually the 3rd time in court as you know. The case started off in May 2022 when tenant gave me a bad check and then another one in June 2022, his last payment was April 2022, first court case was in August, second one in November,, he keeps telling the court he is looking for financial help from a agency, and he always tells me he is leaving.

The 3rd case was to be February 13, 2023. I told the attorney to cancel that in November and i sent tenant a 30 day notice, that simply means, we don't want any money, we want the property back, the case started with a 7 day notice meaning we wanted funds, and he was able to use that to his advantage to keep going to court, saying that he was trying to seek help. I really believe he is going to try that again, but i will remind attorney that this is a termination case and we are not looking for anything other than a judgment in our favor.

This happened last week with another tenant who tried to pull this, and good thing i was in the zoom hearing, I step in over the attorney to remind him this was a termination case and we did not want any money,, because she said in court that she was waiting on Cera Payments, , Judge asked the attorney who stepped in for him did he know anything about her applying, he said he didn't know, I was floored, because i told Gary the day before court that we did get it and when it was her time to pay, she did not pay at all, which now made 5 more months before this court date. Just when the judge was going to set it aside again, I jumped in and said, She owes 5 months, Cera did pay for her for 6 months already and when it was her time to pay again, she claimed she filed for cera again, and I reminded the judge that this was a Termination case and we was not seeking any money, we just wanted the property back..

She Then ask for 60 days to leave, I said no, the law says 10 days, then the hard luck story comes out, judge fail for it and gave her 73 days to leave, I told the Judge, what's the purpose of having a law in place if it was not going to be followed, this lady owes us 5 months of rent, she works, and you give her a additional 2 and a half months on top of the 5 months she didn't pay?? so now, March20, 2023 is her leave date. If i had not been there, they would have set this case aside again, with another court date in March and maybe get her out by April or may of 2023. The Judges here in 36th district court are absolutely terrible and to tenant friendly

Wild. In the city I rented in in N.C. I think it was 30 days at the max no exceptions ever like majority of the time. My mom was a property manager awhile and I think worse case the sheriff would just go out after a short bit. Hope you get that property back soon.

1) grinding on as a rental manager. Week 100+
gave my boss notice that I would be leaving the company. Told her I really like the company. (Job is not that hard for me either, but I did not tell her that. ) Let her know that I was very flexible and that my old co-worker would be calling her. Told her It may require the old co-worker 2 weeks to give notice and 2 weeks for the overlap and knowledge transfer of my portfolio... so I was ok with 4-6 weeks of notice. I told her that I would give her a formal notice but to let me know what day to put as the last day working for the company. This also gives me time to put my vacation time to use and get any prescriptions refilled etc.

3) purchased more Tesla Stock this last week at $118/share.

4) Hamilton House; applied for online property tax notices and payments. Will be due at end of February.

6) Realtor License. Have meeting with Brokerage #2 next Thursday. Will be more of the same and will take their rates sheet to join and compare.
I also called Brokerage #3. They will call me back and arrange a similar interview.

9) Dehumidifiers worked pretty well. Carpet cleaner did a clean and deodorize. Will have to wait a week to see if the smell is gone/does not come back. Took measurments of carpet just in case I need to replace. I will arrange for a handyman to replace a dozen or so acoustic ceiling tiles that became wet and stained. I will also arrange to upgrade the HVAC Circuit Breaker which is an undersized 30amp for that unit. needs to be 40-50amp.

10) Wainwright Storage. Syndicator emailed me and let me know he only has $200,000 of $$350,000 required funds to complete. Still waiting to hear back from the other investors. I don't really want to invest more in this project unless the syndicator is willing to change the terms and offer more % equity for each $ invested. #1 Week 102? I gave my official notice today. Feb 10, 2023 will be my last day. Depends if they want me to take my vacation days, but that is the date in the letter. I discussed it with my boss and that was the date.
since I won't be posting much about Rental Managment as a job, I thought I would leave you with a few photos from my 2022-06-19 Hoarder visit
If you look closely to the top of the range hood, the tenant attached a fly strip which is completely covered in black dots.. (Flies!!!!)
Green mold on the glass sliding door at the entrance. Thank God i have a very poor sense of smell.

4) Hamilton House; more issues. The sub flooring on the main floor was not installed properly causing the laminate above to crack and break. I did not believe the description in the email , but they sent photos and I was surprised.
More work to be done on a "What I thought was renovated" house. Another issue is that they had a double side lock on one of the entrance doors. This is not permitted by fire code.
The inside lock has to be a thumb turn to unlock. That will also have to be changed. Not expensive, just a nuisance.

6) Realtor License. Met with Brokerage #3 today. It is an unlikely fit. They have a huge office close by, but they are focused on full time realtors and developing their business. They also restrict trading realtors from doing any property management or Strata management. (not that I was interested in doing more of that) My version and reason for the trading license, is that I will have +-3 very large transactions to complete on behalf of my family in the next 5 years in the province of BC. If I charged a standard transaction, each transaction would make more money that I make in a full year as a professional property manager. As it will be for family, I will have to charge much less. The wife won't go for less than 50% discount. If I do any other transactions and earn any fees, that would be a bonus.

8) Detroit PM , emailed me. The eviction hearing has been adjourned until Feb 10, 2023! What a Scam.

12) finished reading Structures (or why things don't fall down by J. E. Gordon). As I am a civil engineer by training, I understood all of the material as I had studied most of it 30 years ago. It goes from simple materials to buildings then to larger structures like bridges, then to sail ships, steamships, boilers & pressure vessels and then planes. This is a critical book for reading if you want to work for space X as the obvious next step in that book is Space Vehicles. What they are talking a lot about in the book is MAX Q. Watch a Space X video of Falcon Heavy.. and the critical point of the mission is some 90 seconds into the trip where they hit Max Q. I am sure this varies depending on the payload and where they are going but max Q is the point of maximum stress on the structure or in this case "Rocket."

Things I did this last 2 weeks to further my goals.


1) Week 104 finished. I was at a company lunch today and my boss congratulated me on 2 years (to the day) Jan 27, 2021.
My last day scheduled is February 10.

3) Equities Investing. More investing. Last week I purchased Tesla at $129/Share. This week I purchased Tesla at $158/share. I also shorted more GM at $36.67

4) More fixes in Hamilton House for a leak in the basement. I knew about this one, because my son told me about it prior to purchase.
Approved the permanent fix and work to connect a new exterior drain tile to the rest of the drainage.

6) Realtor License. I (briefly) interviewed my 4th RE Trading Company. The brokerage specializes in investors and realtors that also own investment property.
The First and only question was do they also have a rental department or a Strata department. (no on both)
I will likely go with Broker #1. .. plan to contact them this week and sign up as soon as I leave my current company so there is no laps in my license.
If you did not know, there has to be a broker with the appropriate license in the company for agents to practice in that area. Ie. if you are at a trading company that only has a Trading Broker, any agents that have a trading and Strata license are not permitted to provide any Strata services.
My current company has Strata and Rental Brokers but no Trading Broker, so I am not permitted to do any real estate trading services. The company that I am going to has all three.

This is a 2nd round of financing for this project. Ie. they probably had a short term loan for 20M or so and now it is re-adjusting at a much higher rate.
Meeting is tomorrow 9-10am. Will see what they say!

Ie. the PM just used the same Partnership agreement and missed some of the changes. Told him we can have a meeting next week to discuss a couple issues such as keyman insurance and the obligation of remaining partners to purchase the shares of a deceased/bankrupt partner. etc.

This is the written decision of the Arbitrator re#1 Hoarder Eviction
All personal references are removed and only Initials are used to identify individuals.

This is why I took this job... so I can see what is needed and expected when faced
with a tough situation as an owner.... so when It happens to my own properties,
I can respond in an appropriate manner.



The tenant did not attend this hearing, although I left the teleconference hearing
connection open until 10:08 am in order to enable the tenant to call into the hearing
scheduled to start at 9:30 am. The landlord was represented by two agents (“WF” and
“SW”). Both were given a full opportunity to be heard, to present affirmed testimony, to
make submissions and to call witnesses. I confirmed that the correct call-in numbers and
participant codes had been provided in the Notice of Dispute Resolution Proceeding. I
used the teleconference system to confirm that WF, SW, and I were the only ones who
had called into the hearing.
WF testified he served that the tenant with the notice of dispute resolution package and
supporting documentary evidence by posting them on the door of the rental unit on June
23, 2022. He submitted proof of service form (RTB-9) and a photo of an envelope taped
to the door of the rental unit confirming this. I find that the tenant is deemed served with
these documents on June 26, 2022, three days after WF posted them, in accordance
with sections 88, 89, and 90 of the Act.
The tenant did not provide the landlord or the Residential Tenancy Branch with any
documentary evidence in response to the landlord’s application.
Issues to be Decided
Is the landlord entitled to:
1) an order of possession;
2) recover the filing fee;

While I have considered the documentary evidence and the testimony of the parties, not
all details of their submissions and arguments are reproduced here. The relevant and
important aspects of the parties’ claims and my findings are set out below.
The owner of the rental unit and the tenant entered into a written tenancy agreement
starting March 15, 2018. Monthly rent is $1,050 and is payable on the first of each
month. The tenant paid the landlord a security deposit of $525, which the landlord
continues to hold in trust for the tenant.
The landlord named on this application is the owner’s property management company.
A copy of the agency agreement authorizing the landlord to act on the owner’s behalf
was entered into evidence.
WF testified that in February 2022, the owner decided that she wanted to sell the rental
unit. He testified that in order to facilitate the sale, her realtor (SW) needed to take
photographs of the rental unit to post as part of the listing. He attempted to arrange for
himself and SW to gain access to the rental unit to take these photographs. He testified
that tenant delayed this visit three times, stating that she needed time to clean up.
On March 21, 2022, WF and SW attended the rental unit for the purpose of taking
photographs for the listing. They discovered that the rental unit was overflowing with
garbage, food waste, and miscellaneous items. They submitted photographs of the
condition of the rental unit (taken from the entryway) into evidence. They show garbage
piled up in the kitchen to the height of the countertops, garbage piled atop the stove, fly
strips covered in flies hanging from the ceiling, mold on the walls, cabinet doors and
mirrors, dirty food containers on the floor and dining room table, dirty laundry piled in the
entryway, and miscellaneous refuse throughout the living space.
WF and SW testified that they had difficulty opening the door to the rental unit due to
the amount of garbage in the entryway. They testified that when they opened the door
they cleared a small part of the entryway floor. WF testified that there were “a couple
dozen flies” buzzing around. SW testified that the smell was “horrific,” and the entire
rental unit smelled “moldy, horrible, and damp”. FW testified that he does not have a
good sense of smell and could not confirm this.
On March 23, 2022, WF wrote to the tenant demanding that she clean the rental unit by
April 6, 2022.
WF also obtained a quote from a biological hazard remediation company for cleaning
the rental unit. They estimated that it would cost between $6,000 and $9,000 to
remediate the rental unit. The landlord submitted a copy of the email containing the
quote into evidence.
WF and SW returned to the rental unit on April 13, 2022 and found the rental unit to be
in a similar condition. The landlord submitted photographs confirming this.

WF then served the tenant with a one month notice to end tenancy for cause on April
22, 2022 by registered mail. The tenant did not dispute this notice. In a subsequent
conversation with the tenant, WF advised her of this notice. He testified that the tenant
told him that she never received it. WF speculated that the tenant may have lost the
package (or the registered mail slip) in the debris in the rental unit. In any event, the
tenant did not move out on the effective date of the notice (May 31, 2022).
WF testified that he visited the rental unit on June 2, 2022, to see if the tenant had
vacated. She had not. He testified that he knocked on the door, and the tenant
answered, standing in the doorway. He could see five or six bags of garbage in the
living room of the rental unit from where he stood, but that the tenant would not let him
in. He testified that the rental unit still appeared dirty and that there was a significant
amount of mold on the near in the entryway. The landlord submitted a single photo
showing the condition of the rental unit as it could be seen from the entryway.
The entryway and the portion of the living room visible appear cleaner than they did on
the previous two visits, however, there remains a significant amount of debris. I note
that the floor of the rental unit is visible in this photograph whereas it was not in previous
photographs. Due to his poor sense of smell, WF was unable to comment on the odor of
the rental unit. WF did not see the kitchen or bedroom, so he was unable to say what
the condition of those rooms was.
The tenant has paid rent for June and July 2022 which the landlord has accepted for
use and occupancy only. The landlord submitted copies of invoices showing it accepted
rent for this purpose into evidence.
Analysis
Section 56 of the Act sets out the criteria that must be met for a landlord’s early end to
tenancy application:
Application for order ending tenancy early
56(2) The director may make an order specifying an earlier date on which a
tenancy ends and the effective date of the order of possession only if satisfied, in
the case of a landlord's application,
(a) the tenant or a person permitted on the residential property by the
tenant has done any of the following:
(i) significantly interfered with or unreasonably disturbed another
occupant or the landlord of the residential property;
(ii) seriously jeopardized the health or safety or a lawful right or
interest of the landlord or another occupant;
(iii) put the landlord's property at significant risk;
(iv) engaged in illegal activity that

(A) has caused or is likely to cause damage to the landlord's
property,
(B) has adversely affected or is likely to adversely affect the
quiet enjoyment, security, safety or physical well-being of
another occupant of the residential property, or
(C) has jeopardized or is likely to jeopardize a lawful right or
interest of another occupant or the landlord;
(v) caused extraordinary damage to the residential property, and
(b) it would be unreasonable, or unfair to the landlord or other occupants
of the residential property, to wait for a notice to end the tenancy
under section 47 [landlord's notice: cause] to take effect.

Rule of Procedure 6.6 states:
6.6 The standard of proof and onus of proof
The standard of proof in a dispute resolution hearing is on a balance of
probabilities, which means that it is more likely than not that the facts occurred as
claimed.
The onus to prove their case is on the person making the claim. In most
circumstances this is the person making the application.
As such, the landlord must prove it is more likely than not that the tenant’s conduct
meets the criteria set out at section 56(2) of the Act.
I accept the undisputed testimony of WF and SW. Based on their testimony, supported
by the photographs admitted into evidence, I find that the tenant kept significant
amounts of garbage, refuse, food waste, and other debris in the rental unit. I find that
the condition the tenant kept the rental unit caused it to fail to meet reasonable health,
cleanliness, and sanitary standards. I accept that, at the time SW visited the rental unit,
the odor emanating from the rental unit was extremely unpleasant, and that there was a
large number of flies in the rental unit.
I find that the amount of refuse kept in the rental unit poses a significant fire risk to the
residential property, in particular due to the fact that refuse was piled the top of stove.
Additionally, I find that the condition the tenant kept the rental unit caused, or is likely to
cause, damage the landlord’s property (specifically, the rental unit itself).
I accept that as of June 2, 2022, the rental unit may have been cleaner than it
previously was. However, the portions of the rental unit visible in the photograph
provided depict living area which is still considerably unclean. Furthermore, I have no
evidence before me as to the condition of the kitchen, or other parts of the rental unit
which are not visible from the front entrance. I accept WF’s testimony that he was
unable to enter the rental unit due to the tenant impeding his access. I will not speculate

as to the condition of the parts of the rental unit which are not visible in the photograph.
The tenant, having been duly served with notice of this application, could have attended
the hearing to provide evidence on this point.
In light of the condition of the rental unit previously, and in light of the fact that the tenant
barred access to the rental unit, I find it is more likely than not that the remainder of the
rental unit is in a condition similar, if not worse, the portion visible in the June 2, 2022
photograph.
As such, I find that even in this slightly ameliorated state, the debris in the rental unit
continues to pose a fire hazard and is likely to cause damage to the landlord's property.
As such, I find that the landlord has satisfied the requirements set out at section
56(2)(a) of the Act.
Due to the severity of the condition of the rental unit, the fact that the landlord has
previously served a one month notice to end tenancy, and that the tenant has failed to
vacate the rental unit by the effective date, I find it is unreasonable to make the landlord
wait to end the tenancy pursuant to a one month notice to end tenancy for cause. As
such, I find that they requirements set out at section 56(2)(b) of the Act has been met.
At the hearing, WF stated that the landlord was seeking in order of possession effective
July 31, 2022, given that the tenant had paid rent for the month of July (albeit for use in
occupancy only), and in order to give the tenant sufficient time to remove her
possessions and clean the rental unit prior to vacating.
Accordingly, I grant the landlord and order of possession affective July 31, 2022 at 1:00
PM.
Pursuant to section 72(1) of the Act, as the landlord has been successful in the
application, it may recover the filing fee from the tenant.
Pursuant to section 72(2) of the Act, the landlord may retain $100 of the security deposit
in satisfaction of this amount. the landlord must handle the balance of the deposit in
accordance with the Act.
Conclusion
The landlord is successful in this application.
Pursuant to section 55 of the Act, I order that the tenant deliver vacant possession of
the rental unit to the landlord by July 31, 2022 at 1:00 pm.
