i think tobey maguire should have to pay back the money. same for leo and the rest of the crew. they used trickery to obtain this money which was stolen from hard working citizens.

the ruderman cat needs to have an additional 3 yrs tacked on to his sentence for gambling away his client's money. if he had spent it on private school for his kids or a nice boat then that would have been money not considered to be wasteful.

Money is gone, saying it needs to be given back is stupid.

People invested in the hedge fund so he could invest it into x, if x included trying to clean up some poker game (though that is probably not even legal

), nobody is responsible. If he wasn't supposed to be playing poker with the money, it's his and only his responsibility.

Actually, to say something semi-serious about a topic that really doesn't deserve serious treatment, I suspect the problem is that even if the game is illegal, you don't generally get to rescind already-completed illegal transactions. For instance, drug deals are illlegal, but you can't sue your drug dealer and ask for a refund of the money that you bought a kilo of cocaine with because the transaction was illegal.

Thus, either (1) this poker game is legal in California, or (2) it's illegal, but this guy can't get his money back because he was participating in an illegal transaction.

It's not the first time players are being sued, this sounds similar to the Illinois online players being sued for winning Illinois Pros Getting Sued for Winning Online I believe this case in Illinois is still pending

Everyone in this forum seems to think that Tobey M is going to get to keep all of this money he won from the jailbird scum. My interpretation of the story is different. It seems what they are suing for is this......Scum stock broker lost money on credit to Tobey M. and he simply settled up by transferring investors money into an account for Spiderman. I'm no lawyer but I would think the plaintiff's would have a case.

I'm no lawyer, but as best I can tell from the complaint and my limited understanding of how bankrupcy works their core argument seems to be

In a bankrupcy there are laws governing the order debts are paid back by whatever went bankrupt and they're still owed money and Toby was paid "debts" before them so he has to give it them.

I think that's gonna fail pretty miserably for a lot of different reasons.
