No, like most cases, it is not clear who will win, the claims are not clear cut, but then none are; nor are they meritless, as the common law principles that form the basis for these claims pre-date the U.S.; so rather than both sides spending large sums of money on lawyers they reach a settlement that takes into account the sum at risk and the probability of success as estimated by the parties to the action. Arguably, it's the lawyers who lose when the parties make a reasonable compromise. The parties get peace, certainty, less attorney fees and a quicker resolution.
