You can keep saying it's legal in the state all you want. It is still illegal federally. If and when the federal government enforces its laws your state argument is moot. If you cross state borders you can run into federal issues, even if it's legal in both states.

That something is "legal in the State" may be extremely important, contrary to your analysis of the prosecution being discussed.

How do you account for the massive spread of State-licensed marijuana dispensaries across so many jurisdictions and the complete lack of enforcement that I have heard of against such businesses, where they are operated in accordance with State rules where they are based ?

This certainly was a criminal action in federal court, but why was it brought ? Because the activity involved was not one licensed by the State of California for these defendants under State laws.

It wasn't legal in CA to make unlicensed sales. They seized 2,000 pounds worth about $6 million. He was wholesaling it and apparently bought it from illegal channels. I don't care for these drug laws, but I can see why he was prosecuted.

Protip for anyone who ever beats, or largely beats (ultra light sentence) a charge- questionable areas that might be 'gray' for other are black and white for you. You either live like a ****ing saint, or expect the AUSA/Prosecutor who missed you that one time to casually check in what you're up to these days, from time to time as the years roll on, and drop the hammer as soon as you go public with anything he can make hay with.

The right play for him when the governments first effort went down was to mitigate it as much as possible, sell the lot here and move to another country, They NEVER FORGET cases they lose.

Also, unless he got his citizenship in the meantime, would bet big he's on the hook for a deportation, given that they tried/missed once but now have him in federal prison.
