Your proposal is ludicrous. Your hypothetical presents an incompetently run event, not a problem your so-called solution would address. What you propose is idiotic and shows zero understanding of tournament or room operation or management.
Better training for the floor personnel and a clear authoritative role in booting offending players from the game, and with proper review, from the room.
I've been playing live for 40+ years and have never had to suffer through a table with what you call "speech play" being tolerated by the floor. A rule of no direct P2P needling/annoying speech, subject to the target or table's complaint to the dealer to call the floor and ejection of a repeat offender would give the floor clear authority to stop that nonsense.
Calling offensive, inappropriate conduct "speech play" does not license the activity. There ain't no First Amendment right in a poker game run by a private company. If carried too far, speech play" could see a 2d Amendment, stand-your-ground solution privately exercised by the offended party.
