Not necessarily... depending on the geography of the room, this might be the best vantage point to show both individuals. Again, I've never been there, so for all I know there is an entire football field-sized area beyond camera left.
Furthermore, I still feel like the photog was trying to be discreet. If he didn't want to be seen taking a photo (either by the subjects themselves or by those around them), he would not move to a spot where he could expertly compose the shot, hold the phone still enough for the autofocus to lock in, and fire.

Funny that you say that -- whenever I see people taking photos with an phone, they always seem to hold it vertically, even when their scene would warrant turning the device sideways. Always bugs me for some reason.
I remember some girl asking me to take a photo of her and her friends at a baseball game. This was before the iPhone had taken off -- it was one of those clamshell types of phones. Since there were five people standing in a row, I instinctively turned the phone sideways and shot. (Kinda reminded me of that gangsta way of holding a pistol.) When I handed her the phone to show her the photo, she asked me to take it again, only in portrait mode. When I explained that everyone fits better if I hold the camera sideways, she said, "I know, but I don't want to turn the camera when I show it to people."
I wonder if that girl took this photo.
