The caveat here is that Lindgren was apparently so bad at fantasy sports no one cared he likely couldn't pay.

Not the first time this has happened. People take action from someone they know has a history of not paying because they are a huge favorite. Then they complain when the guy doesn't pay.

If you read back through the FFB thread. You will see that not all of the people knew he was a slow payer. They knew he sucked at FFB. But some thought he was swimming in money with FTP and all. Not in crazy debt. Yes some people knew he was slow to pay. But not everybody. And DN came in acting like everybody knew. And if you didn't know it was your own fault.(which very well may be true)

as a formerr ftp paid pro, edog could just claim this was money owed him, since i doubt any paperwork was ever drawn up on the loan.

tbh he has a case assuming Full Tilt agreed to pay for it should he have lost. (he hasn't confirmed this) but I expect that this was a stipulation.

I don't mind a company buyout and the new owners wanting to recoup losses as long as they're prepared to pay the expenses. Consistency is the important thing.

In the PStars agreement with the DOJ, PStars specifically did not acquire nor was to be responsible for ANY of the debts or liabilities the old FTP may have had, aside from the player monies due specifically to ROW players. Except for those player accounts every other thing acquired by PStars in the settlement were assets, not liabilities. The assets acquired by the agreement included the debts of very specific pro players, listed in a very specific excel spreadsheet, that had borrowed money from FTP.

Consequently, just like PStars, Amaya has no responsibility to pay any claim from any person or entity that may have been owed money by the old FTP or had / has a claim against the former FTP companies.

These loans/debts, which were technically accounts receivable due the old FTP, became assets (accounts receivable) of PStars and these assets / accounts receivable passed to Amaya when they purchased PStars. Amaya is now suing Lindgren to collect the money he borrowed from the old FTP, a debt they now own, just as banks and other creditors do every day.

He also owed hundreds of thousands to various players in gambling debts and told them basically to **** off and I'm not paying you back. He also lied about his financial situation for months when other people still thought he was swimming in free Fulltilt money. Other than that he has been Mother Teresa...

I am assuming that PS asked him for the money before they took him to court, maybe he responded like the degen he is.

Could be that they took it personal and want him destroyed just because they can. They probably are paying a fleet of lawyers anyway.

It seems some are unfamiliar with the business world. In business when someone owes you money you make reasonable efforts to get them to voluntarily pay.

Failing to get the debtor to pay voluntarily, the only recourse for a business that wants its money back is to start a proceeding to enforce payment. Sometimes the business will not pursue the action if the debtor is known to be incapable of repayment, but this is often unknown. Does the entity know that Lindgren will never make money? Do they know all of the assets he has? Probably not.

So they seek a judgment rendered by a court. This then empowers collection proceedings. A debtor will often be required to stand for an exam, under oath, revealing the debtor's assets.

A judgment allows for liens against property owned by the debtor, real and personal. It is very easy to lien real property. It is very easy to place a lien on a bank account and get the bank to turnover the funds. It allows the creditor to seek garnishment of wages. It also keeps the debt live. It depends on the jurisdiction under which the judgment was obtained, but judgments are often collectible for 10 or more years. In New York, for example, it is quite easy to extend judgments for many more years than 10. Plus, the court's often grant interest and that can be a healthy amount. 9% is typical here in New York.

Businesses of this size are not generally interested in destroying people or setting examples. That's mafia stuff. These businesses just want their money. If businesses took the word of debtor, or the word on the rumor mill that a debtor had no money to pay, they would be foolish not to act upon this size of a debt. Get the judgment and make him reveal what he has and take what you can now and into the future.

Even if that is nothing now, it is not necessarily always going to be nothing. A debtor that the company does not have a judgment against is free to do whatever they want with their assets and earnings. That all changes once the judgment is obtained.
