And, when it comes to pot, there are a lot of jurisdictions that don't hammer someone even if the law would have permitted it. For example, that weight in Texas would be a second degree felony, carrying a penalty of UP TO twenty years in TDCJ. However, the low end of the range is only two years, with parole eligibility coming inside of three calendar months. Granted, one is not likely to make that initial parole without hiring competent counsel, but the reality is that one could have that weight and not get much of a sentence. Lots of those sorts of cases in far north Texas with the I-40 corridor running east-west and also the I-35 corridor from south Texas on north.
In fact, as penalties go, without any history of conviction, many persons with that weight in THIS State would likely be offered a deferred disposition that, successfully completed, leaves them with no conviction at the back end of the term of supervision...
